GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to epinephrine auto- injectors in schools THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 3000-cc to read as follows: S 3000-CC. EPINEPHRINE IN SCHOOLS. 1. FOR PURPOSES OF THIS SECTION: (A) "ANAPHYLAXIS" MEANS A POTENTIALLY LIFE-THREATENING HYPERSENSITIVI- TY OR ALLERGIC REACTION TO A SUBSTANCE. I. SYMPTOMS OF ANAPHYLAXIS MAY INCLUDE SHORTNESS OF BREATH, WHEEZING, DIFFICULTY BREATHING, DIFFICULTY TALKING OR SWALLOWING, HIVES, ITCHING, SWELLING, SHOCK, OR ASTHMA. II. CAUSES OF ANAPHYLAXIS MAY INCLUDE, BUT ARE NOT LIMITED TO, INSECT STINGS OR BITES, FOODS, DRUGS, AND OTHER ALLERGENS, AS WELL AS IDIOPATH- IC OR EXERCISE-INDUCED ANAPHYLAXIS. (B) "TRAINED PERSONNEL" WITH RESPECT TO AN ELEMENTARY OR SECONDARY SCHOOL SHALL MEAN AN INDIVIDUAL: I. WHO HAS BEEN DESIGNATED BY THE PRINCIPAL (OR OTHER APPROPRIATE ADMINISTRATIVE STAFF) OF THE SCHOOL TO ADMINISTER EPINEPHRINE ON A VOLUNTARY BASIS OUTSIDE THEIR SCOPE OF EMPLOYMENT; II. WHO HAS RECEIVED TRAINING IN THE ADMINISTRATION OF EPINEPHRINE; AND III. WHOSE TRAINING IN THE ADMINISTRATION OF EPINEPHRINE MEETS APPRO- PRIATE MEDICAL STANDARDS. 2. (A) EACH SCHOOL SHALL TRAIN SCHOOL PERSONNEL TO ADMINISTER EPINEPH- RINE TO ANY STUDENT OF THE SCHOOL REASONABLY BELIEVED TO BE SUFFERING FROM ANAPHYLAXIS. (B) THE MINIMUM TRAINING PROVIDED BY EACH SCHOOL IN THE ADMINISTRATION OF EPINEPHRINE SHALL INCLUDE BUT NOT BE LIMITED TO: I. BILL NUMBER:S6208A TITLE OF BILL: An act to amend the public health law, in relation to epinephrine auto-injectors in schools PURPOSE: The purpose of this legislation is to require each school to keep a supply of epinephrine auto-injectors in a secure yet accessible location on the premises at all times. SUMMARY OF PROVISIONS: Section 1 of the bill adds a new section 3000-cc to the Public Health Law. New section 3000-cc (i) provides definitions for the terms "anaphylaxis" and "trained personnel," (ii) requires schools to train personnel to administer epinephrine to any student reasonably believed to be suffering from anaphylaxis, (iii) requires schools to maintain at least two epinephrine auto-injectors(epi-pens)in separate, secure and reasonably accessible locations, (iv) requires schools to have a plan in place for having at least one person who has been trained in the administration of epinephrine through the use of an epi-pen on the school's premises during operating hours, (v) require schools to send a notice to parents informing them that an epi-pen could be administered to their child if the child is reasonably believed to be suffering from anaphylaxis, (vi) requires schools to obtain epi-pens from appropriate medical professionals, (vii) requires schools to call 911 as soon as is safely possible after the administration of an
