TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to including vehicles operated by sanitation workers in the definition of "hazard vehicle"
This legislation would include vehicles operated by sanitation workers in the definition of hazard vehicle.
SUMMARY OF PROVISIONS:
Section 117-a of the Vehicle and Traffic Law is amended to include vehicles operated by sanitation workers in the definition of "hazard vehicle".
In the span of just three months in late 2013, both a sanitation employee and a recycling employee in the Town of Oyster Bay were struck by vehicles while performing their duties.
Under current law, sanitation and recycling vehicles are not included under the protections provided to hazard vehicles in Section 117-a of the Vehicle and Traffic Law. Other vehicles currently protected include construction vehicles, highway maintenance vehicles and snow and ice removal vehicles.
This legislation would include vehicles operated by a sanitation or recycling worker in their performance of his or her duties. A violation of this section would be punishable as a traffic infraction.
This act shall take effect immediately.
