BILL NUMBER:S6235 TITLE OF BILL: An act to amend the education law, in relation to limiting the use of assessments administered to students in grades kindergarten through grade two for diagnostic purposes PURPOSE: This bill prohibits school districts from using state developed or comparable assessments for any purpose other than diagnosis. SUMMARY OF PROVISIONS: Section 1 adds section 319 to the education law to require the commissioner to prohibit the administration of state developed or other assessments to students in kindergarten, grade one or made two for any purpose other than diagnosis. Section 2 makes this act effective immediately. JUSTIFICATION: Although the State does not require it, many school districts are beginning to administer commercially developed standardized tests to students in the early grades. These tests are not being used for diagnostic purposes or to identify academic needs. Assessing students

MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to limiting the use of assessments administered to students in grades kindergarten through grade two for diagnostic purposes THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 319 to read as follows: S 319. KINDERGARTEN THROUGH GRADE TWO ASSESSMENTS; DIAGNOSTIC PURPOSES. NOTWITHSTANDING ANY OTHER PROVISION OF LAW OR REGULATION TO THE CONTRARY, THE COMMISSIONER SHALL PROHIBIT THE ADMINISTRATION OF STATE DEVELOPED ASSESSMENT OR OTHER COMPARABLE ASSESSMENTS TO STUDENTS ENROLLED IN KINDERGARTEN, GRADE ONE OR GRADE TWO THAT ARE BEING USED FOR ANYTHING OTHER THAN DIAGNOSTIC PURPOSES. PROVIDED FURTHER, SCHOOL DISTRICTS' ANNUAL PROFESSIONAL PERFORMANCE REVIEW PLANS SHALL USE ONE OF THE FOLLOWING OPTIONS TO COMPLY WITH PARAGRAPH F OF SUBDIVISION TWO OF SECTION THREE THOUSAND TWELVE-C OF THIS CHAPTER FOR TEACHERS OF STUDENTS ENROLLED IN KINDERGARTEN, GRADE ONE OR GRADE TWO: DISTRICT, REGIONAL, OR BOCES DEVELOPED ASSESSMENTS; SCHOOL WIDE MEASURE OF EITHER STUDENT GROWTH OR ACHIEVEMENT; OR A STRUCTURED DISTRICT WIDE STUDENT GROWTH GOAL SETTING PROCESS. THE COMMISSIONER SHALL PROMULGATE REGULATIONS TO IMPLE- MENT THE PROVISIONS OF THIS SUBDIVISION. S 2. This act shall take effect immediately.
