TITLE OF BILL: An act to amend the environmental conservation law, in relation to prohibiting the discharge of firearms or long bows within one thousand feet of a school or school playground

PURPOSE OR GENERAL IDEA OF BILL: To increase the distance which hunters may hunt near schools from the current 500 feet to 1,000 feet.

SUMMARY OF SPECIFIC PROVISIONS: Environmental Conservation Law Section 11-0931(4)(a)(2) is amended to increase the distance at which a discharge of a firearm is prohibited near a school or school playground to 1,000 feet from the current law which is only 500 feet.

JUSTIFICATION: Hunting within 500 feet of children attending school is simply too dangerous. At least one incident occurred recently in a Monroe County School district where a hunter's bullet shattered a class window and barely missed the children and teacher who were in the classroom. The state needs to help prevent any further shooting incidents such as this so no child or teacher is put at risk again. Increasing the 500 feet "no hunting zone" to 1,000 feet will help prevent future possible fatal shootings.

O'BRIEN -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to prohibiting the discharge of firearms or long bows within one thousand feet of a school or school playground THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph 2 of paragraph a of subdivision 4 of section 11-0931 of the environmental conservation law is amended to read as follows: (2) discharge a firearm or long bow within (I) five hundred feet from a dwelling house, farm building or farm structure actually occupied or used[, school building, school playground,] or occupied factory or church, OR (II) ONE THOUSAND FEET FROM A SCHOOL BUILDING OR SCHOOL PLAY- GROUND; S 2. This act shall take effect immediately.
