BILL NUMBER:S6334

TITLE OF BILL: An act to amend the labor law, in relation to increasing the minimum wage

PURPOSE: To increase the New York State minimum wage to $10.10 per hour effective on or after December 31, 2014. To create a yearly cost of living adjustment to the New York State minimum wage each year beginning in 2016.

SUMMARY OF PROVISIONS:

§ 1. Subdivision 1 of section 652 of the labor law, as amended by section 1 of part P of chapter 57 of the laws of 2013, is amended to raise the New York State minimum wage to $10.10 on and after December 31, 2014.

In addition, beginning in 2016, no later than March 1st of each successive year, the minimum wage provided for the subdivision shall be increased in proportion to the increase during the preceding calendar year, if any, in the consumer price index for All Urban Consumers as published by the U.S.Bureau of Labor Statics of the United States Department of Labor.

§ 2. This act shall take effect on the ninetieth day after it shall have become a law.

JUSTIFICATION: Recently the Chairman of the President's Council of Economic Advisers, declared that the minimum wage has not kept up with inflation. A minimum wage that does not keep up with inflation forces employees working at or near the minimum wage to live in poverty even though they may work full-time.

Recently, U.S. Rep. George Miller and U.S. Senator Tom Harkin introduced federal legislation titled the Fair Minimum Wage Act to increase the federal minimum wage to $10.10 per hour. In addition, the Fair Minimum Wage Act would index the federal minimum wage to inflation so that the minimum wage will keep up with the cost of living.

This bill will put New York State ahead of the federal legislation and set the New York State minimum wage at the level proposed in the Fair Minimum Wage Act. This legislation will also provide that the New York State minimum wage is indexed to inflation going forward so that the minimum wage will keep up with inflation.

EFFECTIVE DATE: This act shall take effect immediately.

SANDERS -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to increasing the minimum wage THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 652 of the labor law, as amended by section 1 of part P of chapter 57 of the laws of 2013, is amended to read as follows: 1. Statutory. Every employer shall pay to each of its employees for each hour worked a wage of not less than: $4.25 on and after April 1, 1991, $5.15 on and after March 31, 2000, $6.00 on and after January 1, 2005, $6.75 on and after January 1, 2006, $7.15 on and after January 1, 2007, $8.00 on and after December 31, 2013, [$8.75] $10.10 on and after December 31, 2014, [$9.00 on and after December 31, 2015,] or, if greater, such other wage as may be established by federal law pursuant to 29 U.S.C. section 206 or its successors or such other wage as may be established in accordance with the provisions of this article. AS OF MARCH 1, 2016 AND NO LATER THAN MARCH FIRST OF EACH SUCCESSIVE YEAR, THE MINIMUM WAGE PROVIDED FOR IN THIS SUBDIVISION SHALL BE INCREASED IN PROPORTION TO THE INCREASE DURING THE PRECEDING CALENDAR YEAR, IF ANY, IN THE CONSUMER PRICE INDEX FOR ALL URBAN CONSUMERS AS PUBLISHED BY THE U.S. BUREAU OF LABOR STATICS OF THE UNITED STATES DEPARTMENT OF LABOR. S 2. This act shall take effect immediately.
