TITLE OF BILL:
An act
to amend the alcoholic beverage control law, in relation to authorizing
the liquor authority to issue company permits for certain vehicles over
sixty-five thousand pounds

PURPOSE:
To expand the number of alcoholic beverage transportation
permits to wholesalers and manufacturers.

SUMMARY OF PROVISIONS:
Section ninety-four of the alcohol beverage
control law is amended by adding a new paragraph 2-b to provide for
the issuance to licensed wholesalers and manufacturers company
permits that allow vehicles over sixty-five thousand pounds hired or
contracted by such licensee to transport alcoholic beverages with
appropriate documentation as required listing delivery time and date
of destination.

JUSTIFICATION:
Current transportations permits issued under the
Alcohol Beverage Control have limited the number of carriers to
transport large quantities of alcoholic beverages from New York State
breweries and manufacturers. These limitations have increased the
cost of hauling to these breweries and manufacturers by limiting
competition and disadvantage many local haulers that find obtaining a
permit cost prohibitive. This legislation would provide licensed
brewers and wholesalers the ability to provide a company permit to
haulers with full truckloads. The use of company permits will provide
lower hauling costs for state brewers and wholesalers making their
products more competitive. Finally, company permits will provide
environmental benefits by lowering the incidence of empty trucks
leaving breweries and manufacturing sites saving fuel costs to these
haulers and lowering carbon emissions in the state.

  AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
    authorizing  the liquor authority to issue company permits for certain
    vehicles over sixty-five thousand pounds

    THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
  BLY, DO ENACT AS FOLLOWS:


    Section 1. Section 94 of the alcoholic beverage control law is amended
  by adding a new subdivision 2-b to read as follows:

    2-B. IN LIEU OF SUCH PERMITS, THE LIQUOR AUTHORITY MAY ISSUE A COMPANY
  PERMIT  FOR  AN  ANNUAL  FEE OF SIXTY-FOUR HUNDRED DOLLARS. SUCH COMPANY
  PERMIT SHALL COVER ANY AND ALL VEHICLES OVER SIXTY-FIVE THOUSAND  POUNDS
  HIRED  OR  CONTRACTED  FOR A TERM BY SUCH PERMITTEE. IN LIEU OF THE SIGN
  REQUIRED TO BE AFFIXED TO EACH VEHICLE PURSUANT TO  SUBDIVISION  ONE  OF
  THIS  SECTION,  THE  HOLDER OF THE COMPANY PERMIT MAY HAVE IN THE CAB OF
  SUCH HIRED OR CONTRACTED VEHICLE A PHOTOSTATIC COPY, NOTING THE TIME AND
  DATE  ALCOHOLIC BEVERAGES DEPARTED THE COMPANY AND ITS INTENDED DELIVERY
  TIME AND DATE OF DESTINATION OF ITS COMPANY PERMIT ISSUED BY THE AUTHOR-
  ITY.
    S 2. This act shall take effect immediately.
