BILL NUMBER:S6363 TITLE OF BILL: An act to amend chapter 226 of the laws of 2003 relating to establishing the Brookville library funding district in the town of Oyster Bay, county of Nassau, state of New York, in relation to extending the period of time during which such library funding district may be established PURPOSE: This bill extends the time period to establish the Brookville library funding district in the Town of Oyster Bay, in Nassau County. SUMMARY OF PROVISIONS: Chapter 226 of the Laws of 2003 as amended by Chapter 356 of the laws of 2010 is amended to extend the expiration date to create the Brookville Library Funding District from 2011 to 2013. JUSTIFICATION: This legislation has been requested by the Nassau Library System. Following the Chapter, the locality missed the deadline to create the library funding district. This legislation simply extends the expired creation date from 2011 to 2013. The Brookville library funding district would serve residents of the Locust Valley Central School District who currently do not have tax -supported library service. The establishment of this library funding district is vital to the continued improvement and advancement of education and learning for the residents of the serviced area. LEGISLATIVE HISTORY: Chapter Amendment to Chapter 356 of the Laws of 201O. FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend chapter 226 of the laws of 2003 relating to establishing
the Brookville library funding district in the town of Oyster Bay,
county of Nassau, state of New York, in relation to extending the
period of time during which such library funding district may be
established
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 2 of section 4 of chapter 226 of the laws of
2003 relating to establishing the Brookville library funding district in
the town of Oyster Bay, county of Nassau, state of New York, as amended
by chapter 356 of the laws of 2010, is amended to read as follows:
2. Upon receipt by the clerk of the town of Oyster Bay of a petition
signed by not less than 100 voters qualified to vote at a general
election in such town of Oyster Bay and who reside within the boundaries
of the proposed district, the town board of the town of Oyster Bay shall
establish by resolution, the date of such election, which date shall not
be later than October 31, [2011] 2013. The polls shall be open between
the hours of 12:00 Noon to 9:00 p.m. The issues to be decided at such
election shall be:
(a) whether the library funding district authorized by this act shall
be created on or before January 1, [2012] 2014; and
(b) whether the initial budget approved by the town board of the town
of Oyster Bay shall be approved or disapproved.
S 2. Subdivision 6 of section 4 of chapter 226 of the laws of 2003
relating to establishing the Brookville library funding district in the
town of Oyster Bay, county of Nassau, state of New York, as amended by
chapter 356 of the laws of 2010, is amended to read as follows:
6. If a majority of those voting approve both the formation of the
Brookville library funding district and the proposed budget, then such
district shall be established on the terms and conditions set forth in
this act on or before January 1, [2012] 2014.

S 3. Section 12 of chapter 226 of the laws of 2003 relating to estab-
lishing the Brookville library funding district in the town of Oyster
Bay, county of Nassau, state of New York, as amended by chapter 356 of
the laws of 2010, is amended to read as follows:
S 12. This act shall take effect immediately and shall be deemed
repealed on November 1, [2011] 2013 if the creation of the Brookville
library funding district shall not have been approved before November 1,
[2011] 2013 pursuant to section four of this act provided that the town
clerk of the town of Oyster Bay shall notify the Legislative Bill Draft-
ing Commission if the creation of the Brookville library funding
district shall not have been approved before November 1, [2011] 2013
pursuant to section four of this act in order that the commission may
maintain an accurate and timely effective data base of the official text
of the laws of the state of New York in furtherance of effecting the
provisions of section 44 of the legislative law and section 70-b of the
public officers law.
S 4. This act shall take effect immediately.
