BILL NUMBER:S6436

TITLE OF BILL: An act to amend the agriculture and markets law, in relation to making violations of provisions of law relating to the care of animals by pet dealers a misdemeanor

PURPOSE: This bill will increase the penalty for failure to comply the provisions of the Agriculture and Markets Law related to "pet dealers" as defined in that section. Currently a civil penalty, the bill would make such failure to comply a misdemeanor.

SUMMARY OF PROVISIONS:

Section 1 Amends subdivision 2 of Section 406 of the of the agriculture and markets law, as amended by Chapter 251 of the laws of 2013, making the violation of the provisions of Ag & Markets law Article 26-A a misdemeanor.

Section 2 Makes the act effective 30 days after it becomes law.

JUSTIFICATION: The current law lacks sufficient penalty for the failure to provide adequate shelter for violation by Pet Dealers. The current penalty is a civil fine, ranging between $100 and $1000. This bill would increase that to a criminal misdemeanor, providing dogs and cats the protection they need, and law enforcement officials the tools they need to ensure that pet dealers are operating in a proper and legal fashion.

Subdivision 2 of section 406 of the agriculture and markets law, as amended by chapter 251 of the laws of 2013, is amended to read as follows: 2. Violation of any provision of this article[,] is a [civil offense, for which a penalty of not less than one hundred dollars and not more than one thousand dollars for each violation may be imposed] MISDEMEANOR. S 2. This act shall take effect on the thirtieth day after it shall have become a law.
