BILL NUMBER:S6457 TITLE OF BILL: An act to amend chapter 481 of the laws of 1967 establishing and constituting as a separate union free school district certain territory in the town of Greenburgh in the county of Westchester, and providing for its government, in relation to authorizing such school district to use real property located outside of its territorial limits PURPOSE: To authorize the Greenburgh-Graham Union Free School District, which is a "Special Act" public school district, to expand their campus by operating a small public school in the borough of the Bronx for children leaving foster care institutions. SUMMARY OF PROVISIONS: Section 1 adds a new section 4-a to Chapter 481 of the laws of 1967 which states: "No other provision of this act nor any other provision of law shall be deemed to prohibit the school district established pursuant to this act from using any real property owned or leased by The Orphan Asylum Society in the borough of the Bronx, wherever located, for the educational purposes of such school district." JUSTIFICATION: Children leaving foster care programs need help to transition successfully back to regular or special education programs in New York City. Too many of these young people fail after experiencing success in small schools on the grounds of child care agencies while in foster care. At the Graham School in Hastings-on-Hudson, for example, non- readers learn to read in a highly structured literacy program that uses a research based direct instructional model. After a year or so of progress, however, students leave foster care (which is a good thing) and return to New York City schools. But, for many of them, the transition is extremely difficult. As a small step to help correct this problem, the Greenburgh- Graham school district is proposing to operate a small public school in New York City for children leaving foster care institutions. The school would essentially be the third school of their existing "Special Act" public school district, Greenburgh, Graham UFSID, which currently operates an elementary/middle school and a high school on the Graham campus in Hastings. The Greenburgh-Graham special act school district was created by state law in 1967, but the wording does not allow them to operate a public school beyond the immediate boundaries of the district. The proposed legislation would authorize the school to expand by operating a small public school in the Bronx to ease the transition for children leaving foster care institutions. LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS: To be determined. EFFECTIVE DATE: This act shall take effect immediately.

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Chapter 481 of the laws of 1967 establishing and constitut-
ing as a separate union free school district certain territory in the
town of Greenburgh in the county of Westchester, and providing for its
government, is amended by adding a new section 4-a to read as follows:
S 4-A. NO OTHER PROVISION OF THIS ACT NOR ANY OTHER PROVISION OF LAW
SHALL BE DEEMED TO PROHIBIT THE SCHOOL DISTRICT ESTABLISHED PURSUANT TO
THIS ACT FROM USING ANY REAL PROPERTY OWNED OR LEASED BY THE ORPHAN
ASYLUM SOCIETY IN THE BOROUGH OF THE BRONX, WHEREVER LOCATED, FOR THE
EDUCATIONAL PURPOSES OF SUCH SCHOOL DISTRICT.
S 2. This act shall take effect immediately.
