BILL NUMBER:S6501 TITLE OF BILL: An act to amend chapter 326 of the laws of 2006, amending the tax law relating to authorizing the county of Hamilton to impose a county recording tax on obligations secured by mortgages on real property, in relation to extending the expiration thereof PURPOSE: Extends from December 1, 2012 until December 1, 2015, the expiration of the authority of the county of Hamilton to impose a mortgage tax. SUMMARY OF PROVISIONS: Section 1: amends section 2 of chapter 236 of the laws of 2006 to extend the expiration date of mortgage recording tax imposition by Hamilton County to December 1, 2015. Section 2: contains the effective date. EXISTING LAW: Section 2 of chapter 326 of the laws of 2006 which granted Hamilton County the authority to impose an additional mortgage recording tax expires on December 1, 2012. JUSTIFICATION: The Hamilton County Board of Supervisors has requested the introduction of legislation extending their authority to impose an additional mortgage recording tax to December 1, 2015. LEGISLATIVE HISTORY: New Bill. FISCAL IMPLICATIONS: None to the state. LOCAL FISCAL IMPLICATIONS: Hamilton County estimates $90,000 in revenue. EFFECTIVE DATE: This act shall take effect immediately.

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1.
Section 2 of chapter 326 of the laws of 2006, amending the tax law relating to authorizing the county of Hamilton to impose a coun ty recording tax on obligations secured by mortgages on real property, as amended by chapter 187 of the laws of 2009, is amended to read as follows:
S 2. This act shall take effect immediately and shall expire and be deemed repealed December 1, [2012] 2015.
