  printed to be committed to the Committee on Civil Service and Pensions

AN ACT in relation to authorizing Sean William McCabe to file a  request
  for  change  of  benefit  coverage  with  the New York state and local
  police and fire retirement system

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Notwithstanding  any other provision of law, Sean William
McCabe, who is currently a member of the New York state and local police
and fire retirement system, and who was first employed  by  the  Buffalo
Police Department on July 31, 2009, and by virtue of his date of employ-
ment  became  a  member  of the New York state and local police and fire
retirement system covered by the benefits of article 14 of  the  retire-
ment  and social security law and who, for reasons not ascribable to his
own negligence, elected to participate in the  non-contributory  retire-
ment plan contained in subdivision f of section 384 of such law, and who
subsequently  filed an election to be covered by the benefits of article
22 of such law, shall be deemed to be covered by the benefits of article
14 and the retirement plan contained in subdivision  f  of  section  384
retroactive  to  July 31, 2009 if, within one year of the effective date
of this act, he shall file a written request to  that  effect  with  the
state comptroller. Upon the granting of such status, Sean William McCabe
shall  be  granted a refund of any employee contributions made by him to
the New York state and local police and fire retirement system.
  S 2. All past service costs associated with the implementation of this
act shall be borne by the city of Buffalo.
  S 3. This act shall take effect immediately.
  FISCAL NOTE.--This bill will grant Tier 3 status in the New York State
and Local Police and Fire Retirement System to Sean William McCabe,  who
currently  has Tier 5 status and is employed by the City of Buffalo as a
police officer. He originally was assigned Tier 3 status, but he  subse-
quently filed an election form to become covered under the provisions of
Tier 5, as permitted pursuant to Chapter 501 of the Laws of 2009. Member
contributions made while in Tier 5 status will be refunded.
