Requires the state to pay down the gap elimination adjustment; such gap elimination adjustment for the 2014-2015 school year shall equal 50% and the gap for fiscally distressed districts shall equal zero; the gap elimination for the 2015-2016 school year shall equal zero.

BILL NUMBER:S6539 TITLE OF BILL: An act to amend the education law, in relation to requiring the state to pay down the gap elimination adjustment PURPOSE: To require the state to pay down the Gap Elimination Adjust- ment. SUMMARY OF PROVISIONS: Subdivision 17 of Section 3602 of the Education Law is amended by adding two new paragraphs (g) and (h): New paragraph (g) would provide that the GAP elimination adjustment for the 2014-15 school year shall equal 50% of the GAP elimination adjustment for such district for the 2013-14 school year, except for school districts that have been designated by the State Comptroller as fiscally distressed for calendar year 2013. For such distressed school districts, the Gap Elimi- nation Adjustment shall be zero. New paragraph (h) provides that the Gap Elimination Adjustment for the 2015-16 school year shall equal zero. JUSTIFICATION: The Gap Elimination Adjustment (GEA) was enacted during the height of the recession to help eliminate a $10 billion State budget deficit. The Governor is now projecting budget surpluses for New York State. This legislation would eliminate the GEA for fiscally distressed school districts in 2014 and phase out the GEA for all other school districts over the next two years. The GEA cost school districts $1.64 billion in 2013. The Governor's 2014-15 Executive Budget proposal would reduce the GEA by $323 million in 2014. This legislation proposes reduc-

FOR SUCH FISCALLY DISTRESSED SCHOOL DISTRICTS THE GAP ELIMINATION ADJUSTMENT SHALL BE ZERO. H.
