TITLE OF BILL:
An act
to provide for the payment of universal prekindergarten program aid for
the 2009-2010 school year to the Dansville central school district

PURPOSE:
This bill provides for the payment of universal prekindergarten
program aid for the 2009-2010 school year to the Dansville central
school district.

SUMMARY OF PROVISIONS:
Section 1 of this bill provides that the failure of Dansville central
school district to timely file its 2009-2010 notice of fully
implemented universal prekindergarten program form shall not prohibit
the education department from making payment of such aid in a timely
manner, provided that the school district submits this form on or
before April 1, 2012.

Section 2 provides the effective date.

JUSTIFICATION:
While filing an application to receive Universal Pre-Kindergarten
(UPK) funding from the New York State Education Department (NYSED),
an error was made by the Dansville central School District. This
error, resulting in a failure to submit the "2009-2010 Notice of
Fully Implemented UPK Program," was immediately corrected.

This bill would allow the NYSED to forgive this error and allow
Dansville Central School District to recoup the much-needed UPK aid
that it expected.

Minimal to the state.

EFFECTIVE DATE:
This act shall take effect immediately.

AN ACT to provide for the payment of universal  prekindergarten  program
 aid  for  the  2009-2010  school  year to the Dansville central school
 district
 THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM
 BLY, DO ENACT AS FOLLOWS:

 

Section  1.  Notwithstanding  the  provisions of section 3602-e of the
 education law or any other provision of law to the contrary, with regard
 to  the  payment  of  universal  prekindergarten  program  aid  for  the
 2009-2010  school  year  to  the  Dansville central school district, the
 failure  of such school district to timely file its 2009-2010 notice  of
 fully  implemented  universal  prekindergarten program form shall not be
 deemed to prohibit  or  impede  the  education  department  from  making
 payment  of  such  aid in a timely manner if on or before April 1, 2012,
 the Dansville central school district files  such  form.  The  education
 department  shall pay such universal prekindergarten program aid for the
 2009-2010 school year from funds appropriated for prior year claims.
