TITLE OF BILL: An act to amend the town law, in relation to authorizing the town board of the town of Fort Ann, in the county of Washington, to diminish the area of the Lake Hadlock park district

PURPOSE:

Authorizes the town of Fort Ann, in the County of Washington to diminish the area of the Lake Hadlock Park District.

SUMMARY OF PROVISIONS:

Section 1 amends section 202-c of the town law to add a new subdivision 10 to authorize the town of Fort Ann to, upon its own motion and without a petition, but after a public hearing, diminish the Lake Hadlock park district by deleting the five parcels described in the legislation.

Section 2 contains the effective date.

JUSTIFICATION:

The Lake Hadlock Park District is a special district located in the Town of Fort Ann in the County of Washington. This special district was established pursuant to New York State Town Law in 1977 for the benefit of the property owners who have access to or are bordering Lake Hadlock. This special taxing district was described by using tax map parcel identification numbers, however, over the years properties have been subdivided and sold; as a result, these subdivided parcels no longer have access to or boarder Lake Hadlock.

The Town Board does not have the authority pursuant to Town Law section 202-c to remove the parcels on its own motion. Consequently, the town has requested that this special legislation be adopted so that the parcels of real property identified as not being benefitted by the Lake Hadlock Park District can be removed from the special district.

LITTLE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the town law, in relation to authorizing the town board of the town of Fort Ann, in the county of Washington, to diminish the area of the Lake Hadlock park district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 8 of section 202-c of the town law, as added by chapter 394 of the laws of 2010, is renumbered subdivision 9 and a new subdivision 10 is added to read as follows: 10. (A) NOTWITHSTANDING ANY OTHER PROVISION OF GENERAL, SPECIAL OR LOCAL LAW, RULE, OR REGULATION TO THE CONTRARY, WHENEVER THE TOWN BOARD OF THE TOWN OF FORT ANN, IN THE COUNTY OF WASHINGTON, SHALL DETERMINE IT TO BE IN THE PUBLIC INTEREST, SAID TOWN BOARD MAY, UPON ITS OWN MOTION AND WITHOUT A PETITION, BUT AFTER A PUBLIC HEARING HELD IN THE MANNER AND UPON THE NOTICE SPECIFIED IN SUBDIVISION ONE OF THIS SECTION, DIMIN- ISH THE LAKE HADLOCK PARK DISTRICT BY DELETING THEREFROM THE PARCELS OF LANDS DESCRIBED IN PARAGRAPH (B) OF THIS SUBDIVISION LOCATED IN THE TOWN OF FORT ANN AND PRESENTLY INCLUDED IN SAID DISTRICT, PROVIDED THAT SUCH LANDS HAVE NOT RECEIVED ANY BENEFIT FROM SUCH PARK DISTRICT SINCE ITS INCEPTION. IN ADDITION, ANY ORDER ADOPTED BY THE TOWN BOARD PURSUANT TO THIS SUBDIVISION SHALL BE SUBJECT TO A PERMISSIVE REFERENDUM PURSUANT TO ARTICLE SEVEN OF THIS CHAPTER.
