BILL NUMBER:S6753 TITLE OF BILL: An act to amend the environmental conservation law, in relation to the provisions of grants for the best available retrofit technology for heavy duty vehicles; and to amend the public authorities law, in relation to authorizing the New York state energy research and development authority to expend funds for retrofit technology for heavy duty vehicles PURPOSE: To provide grants for retrofit technology for heavy duty vehicles. SUMMARY OF PROVISIONS: Section 1 amends Subdivision 3 of section 19-0323 of the Environmental Conservation Law to require The New York State Energy Research and Development Authority to provide grants for the best available retrofit technology for heavy duty vehicles that fall under the Diesel Emissions Reduction Act (DERA). Section 2 amends subdivision 18 of section 1854 of the Public Authorities Law to allow funds from the Green Jobs-Green New York Program to be used for the installation of best available retrofit technology required under DERA.

MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conser- vation AN ACT to amend the environmental conservation law, in relation to the provisions of grants for the best available retrofit technology for heavy duty vehicles; and to amend the public authorities law, in relation to authorizing the New York state energy research and devel- opment authority to expend funds for retrofit technology for heavy duty vehicles THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 19-0323 of the environmental conservation law, as amended by section 1 of part U of chapter 58 of the laws of 2013, is amended to read as follows: 3. Any diesel powered heavy duty vehicle that is owned by, operated by or on behalf of, or leased by a state agency and state and regional public authority with more than half of its governing body appointed by the governor shall utilize the best available retrofit technology for reducing the emission of pollutants. THE NEW YORK STATE ENERGY RESEARCH AND DEVELOPMENT AUTHORITY SHALL PROVIDE TO SUCH STATE AGENCIES AND STATE AND REGIONAL PUBLIC AUTHORITIES, AND CONTRACTORS OPERATING ON BEHALF OF STATE AGENCIES AND STATE AND REGIONAL PUBLIC AUTHORITIES, WITHIN AMOUNTS APPROPRIATED, GRANTS FOR THE BEST AVAILABLE RETROFIT TECHNOLOGY. The commissioner shall promulgate regulations for the implementation of this subdivision specifying that all vehicles covered by this subdivision shall have best available retrofit technology on or before December 31, 2014. This subdivision shall not apply to any vehicle subject to a lease or public works contract entered into or renewed prior to the effective date of this section. S 2. Subdivision 18 of section 1854 of the public authorities law, as added by chapter 488 of the laws of 2009, is amended to read as follows: 18.
