TITLE OF BILL: An act in relation to authorizing the commissioner of environmental conservation to undertake projects to protect the Montauk Lighthouse from shore erosion

PURPOSE:

This legislation would allow the Department of Environmental Conservation to undertake any project to protect the Montauk Lighthouse from shore erosion.

SUMMARY OF PROVISIONS:

This is a special act authorizing the Department of Environmental Conservation to undertake any project to protect the Montauk Lighthouse from shore erosion, notwithstanding any other laws to the contrary.

JUSTIFICATION:

The Montauk Lighthouse, owned by the Montauk Historical Society, is a historically significant site on the east end of Long Island. Unfortunately, the area is seriously threatened by erosion.

The Department of Environmental Conservation is a partner with other levels of government to protect the Montauk Lighthouse, but State law does not allow a State agency to enter into this type of agreement with a not-for-profit corporation.

This legislation would allow such an agreement to protect the Montauk Lighthouse.

THIELE -- read once and referred to the Committee on Environmental Conservation AN ACT in relation to authorizing the commissioner of environmental conservation to undertake projects to protect the Montauk Lighthouse from shore erosion THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of law to the contrary, the commissioner of environmental conservation shall also be authorized to undertake any project to protect the Montauk Lighthouse from shore erosion. S 2. This act shall take effect immediately.
