TITLE OF BILL: An act to amend the education law, in relation to transferring control of the Yonkers education construction fund board to the mayor of the city of Yonkers
PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to transfer control of the Yonkers Education Construction Fund Board of Trustees to the Mayor of the City of Yonkers.
SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill amends subdivision 1 of Section 477 of the education law, as added by Chapter 931 of the laws of 1971 to include the mayor of the City of Yonkers and the Mayor's appointees on the Board of Trustees for the City of Yonkers Education Construction Fund.
The bill provides that the Mayor of the City of Yonkers serves as the chairperson, of the Yonkers Education Construction Fund. The City Council President, Majority Leader and Minority Leader shall also serve on the board. This bill permits the Mayor to appoint four trustees. Two of the four must be current members of the Board of Education. The Mayor and his or her appointees will act in an ex officio capacity during their terms on the board. The Mayor and city council members shall serve on the board during their terms in office. All other trustees shall serve at the pleasure of the Mayor.
Section 2 of the bill is the effective date.
JUSTIFICATION: Under current law, the former Mayor of the City of Yonkers and his Board appointees still have voting rights on the City's Education budget needs. It is necessary to amend the law to allow the current Mayor of the City of Yonkers control of the Board of Trustees for the Yonkers Education Construction Fund and input from the City Council.
