BILL NUMBER:S6788 TITLE OF BILL: An act to amend the mental hygiene law, in relation to the community mental health support and workforce reinvestment program PURPOSE: The bill will require the calculation of savings from in-pa- tient state operated psychiatric hospital bed closures, which determines the funding for the Community Mental Health Support and Workforce Rein- vestment Program (Reinvestment), to be based upon the actual costs of the beds. A schedule of rates for inpatient services is already estab- lished under section 43.01 of the Mental Hygiene Law. SUMMARY OF PROVISIONS: Section 1 states the calculation of savings for purposes of Reinvestment will be calculated consistent with the provisions of Section 43.01 of the MHL, reduced by the vacancy rate of the state operated in-patient hospital bed census for the most recent year available. Section 2 is the effective date. JUSTIFICATION: Since the inception of the Community Mental Health Rein- vestment Act in 1993, the calculations used to determine the value of a state operated in-patient psychiatric hospital bed result in an amount with no substantiating documentation. TKACZYK -- read twice and ordered printed, and when printed to be committed to the Committee on Mental Health and Develop- mental Disabilities AN ACT to amend the mental hygiene law, in relation to the community mental health support and workforce reinvestment program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 41.55 of the mental hygiene law is amended by adding a new subdivision (a-1) to read as follows: (A-1) SUMS OF MONEY ALLOCATED FOR PURPOSES OF THIS ARTICLE SHALL BE DETERMINED CONSISTENT WITH THE PROVISIONS OF SECTION 43.01 OF THIS TITLE AND REDUCED BY A FACTOR DETERMINED AS THE VACANCY RATE FOR THE STATE OPERATED IN-PATIENT PSYCHIATRIC HOSPITAL BED CENSUS FROM THE MOST RECENT YEAR AVAILABLE. S 2. This act shall take effect immediately, provided that the amend- ments to section 41.55 of the mental hygiene law made by section one of this act shall not affect the repeal of such section and shall be deemed repealed therewith.
