BILL NUMBER:S6801 TITLE OF BILL: An act to amend the environmental conservation law, in relation to allowing the use of rifles for hunting in Cayuga county; and providing for the repeal of such provisions upon expiration thereof PURPOSE OR GENERAL IDEA OF BILL: This bill would allow the hunting of deer and bear through the use of a rifle in Cayuga County. EXISTING LAW: Environmental Conservation Law Section 11-0907 currently allows the taking of deer by rifle in counties such as Allegany, Cattaraugus, Chemung, Chenango, Herkimer, Madison, Montgomery, Oneida, Oswego, Otsego, Schoharie, Schuyler, Steuben, Tioga, Wyoming and Yates. JUSTIFICATION: Cayuga County, has requested to be added to the list of counties where sportsmen and women are able to hunt deer and bear with rifles. Since 2005, several counties in the Finger Lakes Region, Central New York and the Southern Tier have been allowed to permit hunting of deer and bear with rifles. There have been very few reported adverse incidents or problems. Given the rural nature of Cayuga County and the safety record of hunters in the counties where rifle hunting has been permitted, it would be reasonable to now permit rifle hunters in Cayuga County the same opportunities. PRIOR LEGISLATIVE HISTORY: New bill. EFFECTIVE DATE: Immediately.

AN ACT to amend the environmental conservation law, in relation to allowing the use of rifles for hunting in Cayuga county; and providing for the repeal of such provisions upon expiration thereof
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as separately amended by chapters 321 and 326 of the laws of 2011, is amended to read as follows:
(i) The counties of Deer, the first Monday Pistol, shotgun, Allegany, Cattaraugus, after November 15 crossbow, CAYUGA, Chautauqua through first Tuesday muzzle loading except that portion of after December 7 firearm, rifle or the county north of long bow only route 20, Chemung, Chenango, Herkimer, Madison, Montgomery, Oneida, Oswego, Otsego, Schoharie, Schuyler, Steuben, Tioga, Wyoming and Yates and that portion of the county of Broome east of the Susquehanna river
S 2. Item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as amended by section 11 of chapter 483 of the laws of 2010, is amended to read as follows:

(i) The counties of Deer and bear, the Pistol, shotgun, Allegany, Cattaraugus, first Monday after crossbow, CAYUGA, Chemung, November 15 through muzzle loading Chenango, Herkimer, first Tuesday after firearm, rifle or Madison, Montgomery, December 7 long bow only Oneida, Oswego, Otsego, Schoharie, Schuyler, Steuben, Tioga, and Yates and that portion of the county of Broome east of the Susquehanna river
S 4. Item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law, as separately amended by sections 2 of chapters 173, 202 and 203 of the laws of 2011, is amended to read as follows:
(i) The counties of Deer and bear, the Pistol, shotgun, Allegany, Cattaraugus, first Monday after muzzle loading CAYUGA, Chemung, November 15 through firearm, rifle or Chenango, Herkimer, first Tuesday after long bow only Madison, Montgomery, December 7 Oneida, Oswego, Otsego, Schoharie, Schuyler, Steuben, Tioga, and Yates, and that portion of the county of Broome east of the Susquehanna river
S 5. This act shall take effect immediately, provided that:
a. the amendments to item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section one of this act shall be subject to the expiration and reversion of such paragraph pursuant to chapters 321 and 326 of the laws of 2011, as amended, when upon such date the provisions of section two of this act shall take effect; b. the amendments to item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section S. 6801 3 two of this act shall be subject to the expiration and reversion of such paragraph pursuant to section 13 of chapter 600 of the laws of 1993, as amended when upon such date the provisions of section three of this act shall take effect; and c. the amendments to item (i) of paragraph a of subdivision 2 of section 11-0907 of the environmental conservation law made by section three of this act shall be subject to the expiration and reversion of such paragraph pursuant to section 17 of chapter 483 of the laws of 2010, when upon such date the provisions of section four of this act shall take effect.
