BILL NUMBER:S6830 TITLE OF BILL: An act to amend the state law, in relation to cessation of jurisdiction of a parcel of land comprising part of the West Point Military Reservation PURPOSE: Authorizes the power to cede to the federal government full concurrent jurisdiction in and over certain lands in Highlands, Orange County, West Point Military Reservation. SUMMARY OF PROVISIONS: The state law is amended by adding a new section 52-c. JUSTIFICATION: Currently, West Point maintains proprietary jurisdiction over the Cantonment Area, which consists of approximately 12,709.41 acres. Unfortunately, this does not provide adequate law enforcement capability to ensure the safety and security of the military reservation. This legislation is important to the security of West Point and the safety of its service members, their families and its employees.

The state law is amended by adding a new section 52-c to read as follows: S 52-C. GOVERNOR MAY EXECUTE DEED OR RELEASE WITH SUNDRY RESERVATIONS; STONY LONESOME AND RANGE AREAS, WEST POINT MILITARY RESERVATION. 1. NOTWITHSTANDING SECTION FIFTY-SEVEN OF THIS ARTICLE, THE GOVERNOR IS HEREBY AUTHORIZED TO CEDE TO THE UNITED STATES FULL CONCURRENT JURISDIC- TION OVER THE TRACTS OF LAND COMPRISING THE STONY LONESOME AND RANGE AREAS OUTSIDE THE STONY LONESOME AND THAYER GATES, UNITED STATES MILI- TARY ACADEMY, WEST POINT MILITARY RESERVATION, ACQUIRED BY THE UNITED STATES FOR MILITARY PURPOSES UPON CONDITIONS THAT THE JURISDICTION SO CEDED SHOULD NOT PREVENT THE EXECUTION ON SUCH TRACTS OF ANY PROCESS, CIVIL OR CRIMINAL, ISSUED UNDER THE AUTHORITY OF THIS STATE, NOR PREVENT FROM OPERATING WITHIN THE BOUNDS OF SUCH TRACTS ANY OF THE LAWS OR REGU- LATIONS OF THE STATE, NOT INCOMPATIBLE WITH THE FREE USE AND ENJOYMENT OF THE PREMISES BY THE UNITED STATES OR THE PURPOSES FOR WHICH SUCH CESSION IS MADE, NOR PREVENT FROM OPERATING WITHIN THE SAME TRACTS OR PARCELS OF LAND THE LAWS OR ORDINANCES OF THE COUNTY OF ORANGE, TOWN OF HIGHLANDS, OR THE VILLAGE OF HIGHLAND FALLS, NOT INCOMPATIBLE WITH THE FREE USE AND ENJOYMENT OF THE PREMISES BY THE UNITED STATES OR THE PURPOSES FOR WHICH SUCH CESSION IS MADE; AND THAT THE UNITED STATES SHALL RETAIN SUCH JURISDICTION SO LONG ONLY AS SUCH TRACTS OR PARCELS OF LAND SHALL BE USED FOR MILITARY PURPOSES. 2. SECTIONS FIFTY-TWO, FIFTY-THREE, FIFTY-FIVE AND FIFTY-SIX OF THIS ARTICLE SHALL NOT APPLY TO THE PROVISIONS OF THIS SECTION. S 2. This act shall take effect immediately.
