BILL NUMBER:S6843

TITLE OF BILL: An act to amend the family court act, in relation to increasing the number of family court judges for the county of Monroe

PURPOSE:

Increase the number of Family Court judges in Monroe County from six to eight.

SUMMARY OF PROVISIONS:

This act amends subdivision (e) of section 131 of the family court act as amended by chapter 178 of the laws of 2000 to increase the number of family court judges from six to eight.

JUSTIFICATION:

Although chapter 178 of the Laws of 2000 increased the number of Family Court Judges from five to six judges, the reasoning for requesting the first judge remains valid for requesting additional judges. Before 2000, the most recent addition to the Family Court judgeship occurred in 1979. Since that time, the number of cases assigned to the court has increased by more than 250 percent and the addition of more than one judge is necessary to counteract the backlog. It is important to maintain the State's commitment to improving and increasing access to the courts. One basic step toward this goal is by providing a sufficient number of judges to caseloads.

LEGISLATIVE HISTORY:

None.

FISCAL IMPLICATIONS:

Salary of Family Court Judge plus administrative costs.

EFFECTIVE DATE:

This act shall take effect immediately except that the family court judges provided for in this act shall first be elected at the general election to be held in November, 2015 and shall first take office January 1, 2016.
