S6857-2011 Memo
BILL NUMBER:S6857 TITLE OF BILL: An act to amend the environmental conservation law, in relation to implementing a demonstration drug disposal program; and providing for the repeal of such provisions upon the expiration thereof PURPOSE: The purpose of this bill is to encourage proper disposal of drugs. SUMMARY OF SPECIFIC PROVISIONS: This bill would require the Department of Environmental Conservation (DEC): * in consultation with the State Police, to establish a one-year demonstration drug disposal program in at least three publicly-available State Police facilities located in urban, suburban and rural areas; * to maintain on its website a list of State Police facilities participating in such demonstration drug disposal program, any information regarding drug disposal procedures for such facilities as well as any existing information concerning drug disposal; and * at the close of the demonstration program, prepare a report detailing: o the quantities of drugs collected; o the effectiveness of each facility location; o information detailing the acceptance methods made available; and o recommendations for any legislative action. JUSTIFICATION:; Expired, unwanted, or unused pharmaceutical drugs require proper disposal in order to prevent accidental ingestion and/or unintended environmental harm. An extensive water analysis conducted by the United States Geological Survey detected at-least one contaminant in approximately 96 percent of the water samples taken from 74 water sources in 25 states and Puerto Rico. Although drug take back days are taking place in some communities,- a more coordinated effort is required to help prevent continued contamination. This legislation would establish a demonstration drug disposal program in representative rural, suburban and urban areas of the State in order to provide data that could be used to determine the most effective methods of disposal. PRIOR LEGISLATIVE HISTORY: New Bill. FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall take effect immediately and shall expire and be deemed repealed December 31, 2014.
