BILL NUMBER:S6859 TITLE OF BILL: An act to amend the correction law, in relation to prohibiting certain uses of state funds PURPOSE: Prohibits the use of state funds to pay for a college degree for an inmate without charging such inmate the actual cost of tuition SUMMARY OF PROVISIONS: Section 1: Prohibits state moneys from being utilized to fund any program of education resulting in the award of a college degree without charging such inmate the actual cost of tuition for such program and in no event shall such inmate be deemed eligible for awards or scholarships funded in whole or in part with state funds. Section 2. Establishes that the effective date shall take effect imme- diately upon becoming law. JUSTIFICATION: Taxpayers, especially those who are struggling to provide for a college education for themselves or for their children should not have the state impose the additional burden of having to pay for the education of inmates. While the goal of achieving a college education for inmates is laudable, this bill ensures that it does not come at the expense of taxpayers.

O'BRIEN -- read twice and ordered printed, and when printed to be committed to the Committee on Crime Victims, Crime and Correction AN ACT to amend the correction law, in relation to prohibiting certain uses of state funds THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The correction law is amended by adding a new section 136-a to read as follows: S 136-A. PROHIBITION ON THE USE OF STATE FUNDS. NOTWITHSTANDING THE PROVISIONS OF SECTION ONE HUNDRED THIRTY-SIX OF THIS ARTICLE, STATE MONEYS SHALL NOT BE UTILIZED TO FUND ANY PROGRAM OF EDUCATION RESULTING IN THE AWARD OF A COLLEGE DEGREE WITHOUT CHARGING SUCH INMATE THE ACTUAL COST OF TUITION FOR SUCH PROGRAM. IN NO EVENT SHALL SUCH INMATE BE DEEMED ELIGIBLE FOR AWARDS OR SCHOLARSHIPS FUNDED IN WHOLE OR IN PART WITH STATE FUNDS. S 2. This act shall take effect immediately.
