Introduced  by  Sen. O'BRIEN -- read twice and ordered printed, and when
  printed to be committed to the Committee on Crime Victims,  Crime  and
  Correction

AN  ACT  to amend the correction law, in relation to prohibiting certain
  uses of state funds

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The correction law is amended by adding a new section 136-a
to read as follows:
  S  136-A.  PROHIBITION  ON THE USE OF STATE FUNDS. NOTWITHSTANDING THE
PROVISIONS OF SECTION ONE HUNDRED  THIRTY-SIX  OF  THIS  ARTICLE,  STATE
MONEYS  SHALL NOT BE UTILIZED TO FUND ANY PROGRAM OF EDUCATION RESULTING
IN THE AWARD OF A COLLEGE DEGREE WITHOUT CHARGING SUCH INMATE THE ACTUAL
COST OF TUITION FOR SUCH PROGRAM. IN  NO  EVENT  SHALL  SUCH  INMATE  BE
DEEMED  ELIGIBLE  FOR  AWARDS OR SCHOLARSHIPS FUNDED IN WHOLE OR IN PART
WITH STATE FUNDS.
  S 2. This act shall take effect immediately.
