BILL NUMBER:S7004 TITLE OF BILL: An act to amend the public health law, in relation to directing the commissioner of health to produce a report on the best practices for the management and treatment of mild traumatic brain injuries in children and adolescents Purpose: Directs the commissioner of health to produce and periodically update a best practices model for the management and treatment of mild traumatic brain injuries. Summary of Provisions: Section 1 amends Section 206 of the public health law by adding a new subdivision 29, directing the commissioner of health to produce a report on the best practices for the management and treatment of mild traumatic brain injuries in children and adolescents and publish this information on the official health department website. Section 2 provides an immediate effective date. Justification: Mild traumatic brain injuries present a serious health threat to

YOUNG -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to directing the commissioner of health to produce a report on the best practices for the management and treatment of mild traumatic brain injuries in chil- dren and adolescents THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 206 of the public health law is amended by adding a new subdivision 29 to read as follows: 29. WITHIN NINETY DAYS OF THE EFFECTIVE DATE OF THIS SUBDIVISION, THE COMMISSIONER SHALL PRODUCE AND PUBLISH, AND PERIODICALLY UPDATE, A REPORT ON THE BEST PRACTICES FOR THE MANAGEMENT AND TREATMENT OF MILD TRAUMATIC BRAIN INJURIES, INCLUDING CONCUSSIONS, IN CHILDREN AND ADOLES- CENTS. THE DEPARTMENT SHALL POST SUCH REPORT ON THE DEPARTMENT'S INTER- NET WEBSITE, IN CONJUNCTION WITH THE INFORMATION REQUIRED TO BE POSTED THEREON PURSUANT TO SUBDIVISION FORTY-TWO OF SECTION THREE HUNDRED FIVE OF THE EDUCATION LAW. BILL NUMBER:S7004A TITLE OF BILL: An act to amend the public health law, in relation to including concussions within the New York state traumatic brain injury program PURPOSE: Creates a concussion management advisory committee to develop recommendations for the traumatic brain injury services coordinating council related specifically to concussions and mild traumatic brain injuries. SUMMARY OF PROVISIONS: Section 2741 of the public health law is amended by adding a new subdivision b which defines the term "concussion." Section 2742 of the public health law is amended to include specific considerations related to concussions within the powers and duties of the traumatic brain injury services coordinating council. Section 2744 of the public health law is amended by adding a new subdivision 4, providing for the establishment of a concussion management advisory committee within the traumatic brain injury services coordinating council to be tasked with developing

YOUNG, HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Health -- reported favorably from said committee, ordered to first and second report, ordered to a third reading, amended and ordered reprinted, retaining its place in the order of third reading AN ACT to amend the public health law, in relation to including concus- sions within the New York state traumatic brain injury program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2741 of the public health law, as added by chapter 196 of the laws of 1994, is amended to read as follows: S 2741. Definitions. As used in this article[, the term "traumatic]: 1. "TRAUMATIC brain injury" means an acquired injury to the brain caused by an external physical force resulting in total or partial disa- bility or impairment and shall include but not be limited to damage to the central nervous system from anoxic/hypoxic episodes or damage to the central nervous system from allergic conditions, toxic substances and other acute medical/clinical incidents. Such term shall include, but not be limited to, open and closed brain injuries that may result in mild, moderate or severe impairments in one or more areas, including cogni- tion, language, memory, attention, reasoning, abstract thinking, judg- ment, problem-solving, sensory perceptual and motor abilities, psycho- social behavior, physical functions, information processing and speech. Such term shall not include progressive dementias and other mentally impairing conditions, depression and psychiatric disorders in which there is no known or obvious central nervous system damage, neurologi- cal, metabolic and other medical conditions of chronic, congenital or degenerative nature or brain injuries induced by birth trauma. 2. "CONCUSSION" MEANS A MILD TRAUMATIC INJURY TO THE BRAIN THAT IS CHARACTERIZED BY IMMEDIATE AND TRANSIENT ALTERATION OF MENTAL STATUS AND LEVEL OF CONSCIOUSNESS, RESULTING FROM MECHANICAL FORCE OR TRAUMA. S 2. Subdivisions 3, 5 and 7 of section 2742 of the public health law, as added by chapter 196 of the laws of 1994, are amended to read as follows: EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
