Amends the definition of "emergency service"; provides that such term shall include returning from the operation, or parking, of an authorized emergency vehicle, when such vehicle is engaged in transporting a sick or injured person, transporting prisoners, delivering blood or blood products in a situation involving an imminent health risk, pursuing an actual or suspected violator of the law, or responding to, or working or assisting at the scene of an accident, disaster, police call, alarm of fire, actual or potential release of hazardous materials or other emergency.

BILL NUMBER:S715 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to emergency operation PURPOSE: The purpose of this bill is to allow those who drive an emergency vehicle the ability to return from the scene with that vehicle. SUMMARY OF PROVISIONS: Bill amends section 1. Section 114-B of the vehicle and traffic law, as amended by chapter 460 of the laws of 1996 to read: Emergency operation shall include returning from such service. JUSTIFICATION: Many counties, towns and village depend on volunteers to handle their emergency vehicles. It is vital service to the people of New York State. Right now those brave men and women who drive a fire truck or any other emergency vehicle cannot return the vehicle from the scene of an emergency. This has put many of our emergency personnel in a situation of breaking the law if they do not have a CDL license. This amendment will change the existing law to allow those who drive the emergency vehicle to many emergency operations including a fire, disaster, police call or scene of an accident to return that vehicle. AN ACT to amend the vehicle and traffic law, in relation to emergency
operation
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 114-b of the vehicle and traffic law, as amended by
chapter 460 of the laws of 1996, is amended to read as follows:
S 114-b. Emergency operation. The operation, or parking, of an author-
ized emergency vehicle, when such vehicle is engaged in transporting a
sick or injured person, transporting prisoners, delivering blood or
blood products in a situation involving an imminent health risk, pursu-
ing an actual or suspected violator of the law, or responding to, or
working or assisting at the scene of an accident, disaster, police call,
alarm of fire, actual or potential release of hazardous materials or
other emergency. Emergency operation shall [not] include returning from
such service.
S 2. This act shall take effect immediately.
