BILL NUMBER:S7163 TITLE OF BILL: An act to amend the public health law, in relation to exempting general hospitals participating in a national study, relating to the limits on the working hours of postgraduate trainees, from rules and regulations establishing minimum standards for hospitals PURPOSE: To allow hospitals to be exempt from regulations regarding postgraduate working hours, in order for the hospital to participate in national studies. SUMMARY OF PROVISIONS: Section one of this bill amends section 2803 of the public health law by allowing for general hospitals to be exempt from NYCRR 405.9 requirements regarding limiting postgraduate trainee working hours, so long as the hospital is participating in a national study regarding postgraduate trainee working hours that is recognized and approved by the Commissioner of Health. Section two has this bill taking effect immediately. JUSTIFICATION:

HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to exempting general hospitals participating in a national study, relating to the limits on the working hours of postgraduate trainees, from rules and regulations establishing minimum standards for hospitals THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 9 of section 2803 of the public health law, as added by chapter 1 of the laws of 1999, is amended to read as follows: (a) General hospitals shall, no later than April first, two thousand, submit to the commissioner a plan for compliance with part four hundred five of TITLE TEN OF the [official compilation of codes, rules and regu- lations of the state of] New York STATE CODES, RULES AND REGULATIONS regarding the working conditions of and limits on working hours for certain members of a hospital's medical staff and postgraduate trainees in such form and manner as specified by the commissioner. PROVIDED, HOWEVER, THAT GENERAL HOSPITALS SHALL BE EXEMPT FROM COMPLYING WITH THE PROVISIONS OF SUCH PART, IF THE GENERAL HOSPITAL IS PARTICIPATING IN A NATIONAL STUDY, REGARDING LIMITS ON THE WORKING HOURS OF POSTGRADUATE TRAINEES, RECOGNIZED AND APPROVED BY THE COMMISSIONER.
