BILL NUMBER:S7201 TITLE OF BILL: An act to amend the state finance law, in relation to purchasing services and commodities SUMMARY OF PROVISIONS: Section 1 of the bill amends section 163 of the state finance law to require that state contractors to submit the average weekly wage paid to employees in each employment category in their required annual employment report. JUSTIFICATION: Current law requires all state contractors to submit an annual employment report. This report requires contractors to list information such as the number of employees employed, the number of hours that they work and total compensation. However, while we know the total amount paid, the public does not have any information on the average wages paid to their employees. The current law does not allow us to know if these employees are being paid a living wage. The state should not be in the business of contracting with vendors that pay low wages. This proposal will allow legislators and the public to know what the average wage is for these employees. LEGISLATIVE HISTORY: New proposal.

SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the state finance law, in relation to purchasing services and commodities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph g of subdivision 4 of section 163 of the state finance law, as added by chapter 10 of the laws of 2006, is amended to read as follows: g. All state agencies shall require all contractors, including sub- contractors, that provide services for state purposes pursuant to a contract, to submit an annual employment report for each contract for services that includes for each employment category within the contract the number of employees employed to provide services under the contract, the number of hours they work [and], their total compensation under the contract AND THE AVERAGE WEEKLY WAGE PAID TO EMPLOYEES IN EACH EMPLOY- MENT CATEGORY. Employment reports shall be submitted to the agency that awarded the contract, the department of civil service and the department of audit and control and shall be available for public inspection and copying pursuant to section eighty-seven of the public officers law provided that in disclosing such reports pursuant to the public officers law, the agency making the disclosure shall redact the name or social security number of any individual employee that is included in such document. S 2. Paragraphs (v) and (vii) of subdivision 14 of section 163 of the state finance law, as added by chapter 10 of the laws of 2006 and para- graph (vii) as renumbered by chapter 137 of the laws of 2008, are amended to read as follows: (v) for each contract for services for state purposes: the number of employees, by employment category within the contract, employed to provide services under the contract, the number of hours they work [and], their total compensation under the contract[;], AND THE AVERAGE WEEKLY WAGE PAID TO EMPLOYEES IN EACH EMPLOYMENT CATEGORY.
