BILL NUMBER:S7246 TITLE OF BILL: An act to amend the penal law, in relation to the promotion of prison contraband Purpose: To enhance the penalties for introducing or possession contraband into our State's prisons. Summary of Specific Provisions: Section 1: Sections 205.20 and 205.25 of the penal law are amended as follows: § 205.20: Promoting prison contraband in the second degree is now a class E felony § 205.25: Promoting prison contraband in the first degree is now a class C felony. Section 2: This act shall take effect immediately. Existing Law: Under sections 205.20 and 205.25 of the penal law, promoting prison contraband in the second degree is a class A misdemeanor and promoting prison contraband in the first degree is a class C misdemeanor.

NOZZOLIO -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to the promotion of prison contraband THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Sections 205.20 and 205.25 of the penal law are amended to read as follows: S 205.20 Promoting prison contraband in the second degree. A person is guilty of promoting prison contraband in the second degree when: 1. He OR SHE knowingly and unlawfully introduces any contraband into a detention facility; or 2. Being a person confined in a detention facility, he OR SHE knowing- ly and unlawfully makes, obtains or possesses any contraband. Promoting prison contraband in the second degree is a class [A misde- meanor] E FELONY. S 205.25 Promoting prison contraband in the first degree. A person is guilty of promoting prison contraband in the first degree when: 1. He OR SHE knowingly and unlawfully introduces any dangerous contra- band into a detention facility; or 2. Being a person confined in a detention facility, he OR SHE knowing- ly and unlawfully makes, obtains or possesses any dangerous contraband. Promoting prison contraband in the first degree is a class [D] C felo- ny. S 2. This act shall take effect immediately.
