BILL NUMBER:S7258 TITLE OF BILL: An act to amend the village law, in relation to the application of certain provisions of law relating to non-resident members of the village of Delanson volunteer fire company PURPOSE OR GENERAL IDEA OF BILL: Allows the Village of Delanson Volunteer Fire Company to recruit and maintain membership in their organization even if such recruitment would result in nonresident members making up more than forty-five per centum of the membership of their fire company SUMMARY OF SPECIFIC PROVISION: Section 1. Amends subdivision 7 of Section 10-1006 of the village law by excluding the Village of Delanson Volunteer Fire Company from the requirement that forty-five per centum of their membership reside within the village Section 2. Establishes an immediate effective date for this act. JUSTIFICATION: Due to the rural nature of the village of Delanson, the Delanson Volunteer Fire Company seeks to recruit members from the surrounding town of Duanesburg in order to maintain adequate membership. Recruitment of members from the surrounding town would enable the Delanson Volunteer Fire Company to continue to offer

TKACZYK -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the village law, in relation to the application of certain provisions of law relating to non-resident members of the village of Delanson volunteer fire company THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 10-1006 of the village law, as amended by chapter 185 of the laws of 1984, is amended to read as follows: 7. The membership of any volunteer fireman shall not be continued pursuant to subdivision five, and persons shall not be elected to membership pursuant to subdivision six, if, by so doing, the percentage of such non-resident members in the fire company would exceed forty-five per centum of the actual membership of the fire company, PROVIDED HOWEV- ER, THAT THE PROVISIONS OF THIS SUBDIVISION SHALL NOT APPLY TO THE MEMBERSHIP OF THE VILLAGE OF DELANSON VOLUNTEER FIRE COMPANY IN THE VILLAGE OF DELANSON, COUNTY OF SCHENECTADY.
