TITLE OF BILL: An act to amend the family court act, in relation to increasing the number of family court judges for the county of Erie

PURPOSE:

Increase the number of Family Court judges in Erie County from six to eight.

SUMMARY OF PROVISIONS:

This act amends subdivision (e) of section 131 of the family court act as amended by chapter 178 of the laws of 2000 to increase the number of family court judges from six to eight.

JUSTIFICATION:

Statewide there are only 153 Family Court Judges for nearly 700,000 filings. With only six judges, Erie County has struggled to keep up with an increasing number of filings for family offenses and orders of protection. Moreover, the median length of processing time for Juvenile Delinquency cases in Erie County has increased 12 days in recent years. The 2014-2015 budget included funding for 20 new family court judges statewide. Erie County needs more family court judges to provide services for the residents of Erie County in a timely manner.

FISCAL IMPLICATIONS:

Salary of Family Court Judge plus administrative costs; funding has been secured in the 2014-2015 budget.

EFFECTIVE DATE:

This act shall take effect immediately except that the family court judges provided for in this act shall first be elected at the general election to be held in November, 2015 and shall first take office January 1, 2016.

GRISANTI -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the family court act, in relation to increasing the number of family court judges for the county of Erie THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision (e) of section 131 of the family court act, as amended by chapter 178 of the laws of 2000, is amended to read as follows: (e) In the county of Monroe there shall be six family court judges and the number of such judges now existing in said county is hereby increased accordingly; in the county of Erie there shall be [six] EIGHT family court judges and the number of such judges now existing in said county is hereby increased accordingly. In the county of Albany there shall be a total of three family court judges and the number of such judges now existing in such county is hereby increased accordingly. S 2. This act shall take effect immediately except that the family court judges provided for in this act shall first be elected at the general election to be held in November, 2015 and shall first take office January 1, 2016.
