BILL NUMBER:S7378 TITLE OF BILL: An act to amend the uniform city court act, in relation to authorizing evening court hours in cities with a population of two hundred fifty thousand or less PURPOSE: To provide flexibility in the scheduling of city court hours, and reduce or eliminate the need for costly expansion and renovation of court facilities. SUMMARY OF PROVISIONS: This bill adds a new Section 2105 to the Uniform City Court Act to allow cities with a population of less than 250,000 to extend the hours to include evenings for the purpose of considering matters that are neither charged as misdemeanors or felonies. JUSTIFICATION: This bill would provide flexibility in the scheduling of court sessions in small cities. By allowing for a split shift, this bill will help facilitate the flow of cases and enable a more efficient use of space, which will in turn reduce or eliminate the need to construct or renovate costly new facilities and court and office space. FARLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the uniform city court act, in relation to authorizing evening court hours in cities with a population of two hundred fifty thousand or less THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The uniform city court act is amended by adding a new section 2105 to read as follows: S 2105. HOLDING OF COURT. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, RULE OR REGULATION TO THE CONTRARY, A CITY WITH A POPULATION OF TWO HUNDRED FIFTY THOUSAND OR LESS MAY EXTEND THE HOURS DURING WHICH THE CITY CONDUCTS COURT PROCEEDINGS TO INCLUDE EVENINGS FOR THE PURPOSE OF CONSIDERING MATTERS THAT ARE NEITHER CHARGED AS MISDEMEANORS NOR FELONIES. S 2. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. SUMMARY OF PROVISIONS: This bill adds a new Section 2105 to the Uniform City Court Act to provide that a city which hosts a city court is authorized to keep its court facilities open in the evening where court administrators determine that the court should schedule night sessions. JUSTIFICATION: This bill seeks to provide flexibility in the scheduling of court sessions in small cities by encouraging the consideration of night sessions By allowing for day and night shifts, this bill would help facilitate the flow of cases and enable a more efficient use of space, which will in turn reduce or eliminate the need to construct or renovate costly new facilities and court and office space. The availability of night sessions may also be more convenient for many citizens. FISCAL IMPLICATIONS:To be determined.
