TITLE OF BILL: An act to amend the village law, in relation to the application of certain provisions of law relating to non-resident members of the village of Blasdell volunteer fire department

PURPOSE: This bill allows the percentage of non-resident volunteer members to exceed forty-five percent of the actual membership of the village fire company of Blasdell, New York.

SUMMARY OF PROVISIONS: Section 1 amends subdivision 7 of section 10-1006 of the village law which forbids the percentage of non-resident volunteer members in village fire companies to exceed forty-five percent of the actual membership of the fire company. The amendment exempts the village of Blasdell, New York volunteer fire department from the requirements of subdivision 7.

Section 2 states that this law shall take effect immediately.

JUSTIFICATION: Currently, village law forbids the percentage of nonresident volunteer members in village fire companies to exceed forty-five percent of the actual membership of the fire company. This negatively impacts village fire companies by making it more difficult to fill their total membership and leaving fire companies with vacancies which could be filled by the membership of non-resident volunteer firefighters. This bill allows the percentage of non-resident volunteer members to exceed forty-five percent of the actual membership of the village fire company. This will help village fire companies obtain greater membership and keep our communities safe.

GRISANTI -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the village law, in relation to the application of certain provisions of law relating to non-resident members of the village of Blasdell volunteer fire department THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 7 of section 10-1006 of the village law, as amended by chapter 185 of the laws of 1984, is amended to read as follows: 7. The membership of any volunteer fireman shall not be continued pursuant to subdivision five, and persons shall not be elected to membership pursuant to subdivision six, if, by so doing, the percentage of such non-resident members in the fire company would exceed forty-five per centum of the actual membership of the fire company, PROVIDED HOWEV- ER, THAT THE PROVISIONS OF THIS SUBDIVISION SHALL NOT APPLY TO THE MEMBERSHIP OF THE VILLAGE OF BLASDELL VOLUNTEER FIRE DEPARTMENT. S 2. This act shall take effect immediately.
