BILL NUMBER:S7414 TITLE OF BILL: An act to amend the public service law and the public authorities law, in relation to requiring that the public service commission ensure equitable treatment of all retail customers of electric corporations and municipal electric utilities PURPOSE: This legislation will require that the Public Service Commission ensure equitable treatment of all retail customers of electric corporations and municipal electric utilities by requiring investor owned utilities include them in any filed storm preparation and response plans. SUMMARY OF PROVISIONS: Sections 1 and 2 of the bill amend the Public Service Law and the Public Authorities Law, respectively, to add a new provision to ensure that storm plans provide for the equitable treatment of all customers of electric corporations and municipal electric utilities. Section 3 of the bill is the effective date. JUSTIFICATION: This legislation will ensure that all retail customers, subjected to power outages that are the result of failures of the surrounding electric corporation's infrastructure are treated equitably during electricity restoration efforts. LEGISLATIVE HISTORY: New legislation. FISCAL IMPACT: None. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT to amend the public service law and the public authorities law, in relation to requiring that the public service commission ensure equitable treatment of all retail customers of electric corporations and municipal electric utilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 21 of section 66 of the public service law, as added by chapter 718 of the laws of 1980, is amended to read as follows:
21. The commission shall require every electric corporation to submit storm plans to the commission for review and approval at such times and in such detail and form as the commission shall require, provided, however, that the same shall be filed at least annually. TO ENSURE THE EQUITABLE TREATMENT OF ALL RETAIL CUSTOMERS IN NEW YORK, THE COMMISSION SHALL REQUIRE THAT THE ELECTRIC CORPORATION'S STORM PLAN RESTORES SERVICE TO RETAIL CUSTOMERS OF ADJACENT ELECTRIC CORPORATIONS AND MUNIC IPAL ELECTRIC UTILITIES THAT DEPEND ON THE ELECTRIC CORPORATION'S FACIL ITIES FOR ELECTRIC SERVICE ON A BASIS COMPARABLE TO ITS RETAIL CUSTOM ERS.

Section 1020-cc of the public authorities law, as amended by chapter 413 of the laws of 2011, is amended to read as follows:
S 1020-cc. Authority subject to certain provisions contained in the state finance law, the public service law, the social services law and the general municipal law. All contracts of the authority shall be subject to the provisions of the state finance law relating to contracts made by the state. The authority shall also establish rules and regu lations with respect to providing to its residential gas, electric and steam utility customers those rights and protections provided in article two and sections one hundred seventeen and one hundred eighteen of the public service law and section one hundred thirty-one-s of the social services law. S. 7414 2 ating equipment established by the public service commission pursuant to subparagraph (ii) of paragraph (a) of subdivision five and subparagraph (ii) of paragraph (a) of subdivision five-a of section sixty-six-j of the public service law. THE AUTHORITY SHALL SUBMIT STORM PLANS, AT LEAST ANNUALLY, IN SUCH A MANNER SIMILAR IN DETAIL AND FORM AS THE PUBLIC SERVICE COMMISSION REQUIRES PURSUANT TO SUBDIVISION TWENTY-ONE OF SECTION SIXTY-SIX OF THE PUBLIC SERVICE LAW. The authority shall let contracts for construction or purchase of supplies, materials, or equip ment pursuant to section one hundred three and paragraph (e) of subdivi sion four of section one hundred twenty-w of the general municipal law.
