BILL NUMBER:S7467 TITLE OF BILL: An act to amend the navigation law, in relation to the base pilotage tariffs at Sandy Hook, Sands Point and Execution Rocks PURPOSE: Increases the base pilotage tariffs at Sandy Hook, Sands Point and Execution Rocks. SUMMARY OF PROVISIONS: This legislation amends Section 88 of the Navigation Law to adjust the pilotage tariff table over a five year period commencing January 1, 2013. As agreed to by the shipping industry, there is a three percent rate increase in 2013, two percent in 2014, three percent in 2015, a two percent increase in 2016 and a two percent increase in 2017. Section 1 amends item (A) of subclause 1 of clause (ii) of subparagraph 1 of paragraph (b) of subdivision 4 of section 88 of the navigation law, as amended by chapter 537 of the laws of 2012. It establishes five new tariff tables, the first is effective January 1, 2013. Each subsequent table replaces its predecessor effective a year thereafter. Section 2 provides that the bill takes effect immediately. JUSTIFICATION: Adjusting the tariff schedule recognizes the change in the nature of vessels utilizing the Port. When the schedule was established 29 years ago, vessel size was well within the established limits. However, during that time, vessels have doubled in size and can accommodate much more cargo. Therefore, the total number of ships has decreased while total tonnage and value of cargo has increased. Schedule adjustments are necessary to compensate for the resulting decreased revenue stream thereby enabling the Pilots to maintain their historically exemplary level of service. The increase is necessary to allow the Sandy Hook pilots to expand educational programs for pilots, fund the cost of newly added employees and increased operational expenses such as insurance and fuel, and to make necessary capital improvements to the pilot base. THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Item (A) of subclause 1 of clause (ii) of subparagraph 1 of paragraph (b) of subdivision 4 of section 88 of the navigation law, as amended by chapter 537 of the laws of 2010, is amended to read as follows:
