BILL NUMBER:S7480 TITLE OF BILL: An act to amend the public health law, in relation to reimbursement for the provision of offsite primary care services PURPOSE: This bill amends the public health law to authorize and pay for house calls made by hospital/clinic employed practitioners. SUMMARY OF PROVISIONS: Section 1 amends the public health law to allow general hospital outpa- tient clinics and diagnostic and treatment centers to provide house calls, in certain circumstances, and receive payment for the services, subject to federal financial participation. Section 2 - Effective Date. JUSTIFICATION: To retain and recruit physicians in rural and under- served communities, hospitals need to employ them. However, once employed by a hospital, physicians are no longer allowed to treat patients in the patients' homes or in nursing homes. This means that elderly, infirmed, and disabled patients must be transported, many by ambulance, to hospital clinics or EDs to receive routine care. Feder- ally Qualified Health Centers can, by federal rules, offer practitioner "house calls." FQHCs are also licensed under Article 28 of the public health law as a diagnostic and treatment center. HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to reimbursement for the provision of offsite primary care services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 2807 of the public health law is amended by adding a new subdivision 22 to read as follows: 22. NOTWITHSTANDING ANY LAW, RULE OR REGULATION TO THE CONTRARY, AND SUBJECT TO THE AVAILABILITY OF FEDERAL FINANCIAL PARTICIPATION, GENERAL HOSPITAL OUTPATIENT CLINICS AND DIAGNOSTIC AND TREATMENT CENTERS SHALL BE REIMBURSED FOR THE PROVISION OF OFFSITE PRIMARY CARE SERVICES TO EXISTING PATIENTS IN NEED OF PROFESSIONAL SERVICES AVAILABLE AT THE GENERAL HOSPITAL OUTPATIENT CLINIC OR DIAGNOSTIC AND TREATMENT CENTER, BUT, DUE TO THE INDIVIDUAL'S MEDICAL CONDITION, IS UNABLE TO RECEIVE THE SERVICES ON THE PREMISES OF THE GENERAL HOSPITAL OUTPATIENT CLINIC OR DIAGNOSTIC AND TREATMENT CENTER. S 2. This act shall take effect on the one hundred twentieth day after it shall have become a law.
