BILL NUMBER:S7485A TITLE OF BILL: An act to amend the public officers law, in relation to residency requirements for peace officers employed by Cornell University PURPOSE: To allow for Cornell University to hire campus police officers that are assigned to the Ithaca campus who live outside of Tompkins County. SUMMARY OF PROVISIONS: Amends section 3 of the public officers law by adding a new subdivision 59, allowing for a peace officer employed by Cornell University and assigned to the Ithaca campus to reside outside of Tompkins County, provided that such person reside in the state of New York. EXISTING LAW: Existing law requires a person to be a resident of the political subdi- vision or municipal corporation of the state for which he or she shall be chosen, or within which his or her official functions are required. JUSTIFICATION: In order to improve hiring, and allow for greater freedom of residency location, this legislation would allow for Cornell University police officers assigned to the Ithaca campus to reside outside of Tompkins County, and still perform their official functions at the university. LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS: None to the state. EFFECTIVE DATE: This act shall take effect immediately.

O'MARA -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern ment Operations -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public officers law, in relation to residency requirements for peace officers employed by Cornell University THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1.
Section 3 of the public officers law is amended by adding a new subdivision 59 to read as follows:
59. IN RESPECT TO PEACE OFFICERS EMPLOYED BY CORNELL UNIVERSITY, AND ASSIGNED TO THE ITHACA CAMPUS, PURSUANT TO SECTION FIFTY-SEVEN HUNDRED NINE OF THE EDUCATION LAW, THE PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDIVISION OR MUNICIPAL CORPO RATION OF THE STATE FOR WHICH HE OR SHE SHALL BE CHOSEN OR WITHIN WHICH HIS OR HER OFFICIAL FUNCTIONS ARE REQUIRED TO BE EXERCISED SHALL NOT PREVENT A PERSON FROM SERVING AS A PEACE OFFICER FOR CORNELL UNIVERSITY OR AS A SPECIAL DEPUTY SHERIFF, AND ASSIGNED TO THE ITHACA CAMPUS, AS DEFINED IN SUBDIVISION FORTY-TWO OF SECTION 2.10 OF THE CRIMINAL PROCE DURE LAW, PROVIDED THAT SUCH PERSON RESIDES IN THE STATE OF NEW YORK.
