BILL NUMBER:S7519A TITLE OF BILL: An act to amend the education law, in relation to authorizing the Rochester city school district to require minors age five to attend kindergarten PURPOSE: To permit the Rochester City School District to require kindergarten attendance. SUMMARY OF PROVISIONS: This bill amends Education Law to allow the Rochester City School District to require attendance in kindergarten. JUSTIFICATION: The Rochester City School District currently provides children a full day kindergarten program in keeping with the numerous studies documenting the educational benefit and related long-term success of early quality education. Unfortunately, too many kindergarten children are absent from school during the year, leaving them without the benefit of this educational experience. The Rochester Board of Education recently adopted a resolution recognizing the importance of kindergarten as part of the educational process and requesting the authority to require kindergarten attendance. The resolution notes that, ".... enumerable studies have documented the value to children of beginning the educational process at an early age in order to prepare them for a life of learning, work and active engagement in society." This measure is designed to address the kindergarten attendance issue in the Rochester City School District by requiring five-year-old children to benefit from the District's kindergarten initiative for long-term academic success. A similar provision in Education Law was adopted for the Syracuse City School District 25 years ago. LEGISLATIVE HISTORY: New bill. EFFECTIVE DATE: Immediately.

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Paragraph c of subdivision 2 of section 3205 of the educa tion law, as added by chapter 546 of the laws of 1987, is amended to read as follows:
c. The board of education of the Syracuse city school district AND THE BOARD OF EDUCATION OF THE CITY SCHOOL DISTRICT OF THE CITY OF ROCHESTER [is] ARE hereby authorized to require minors who are five years of age on or before December first to attend kindergarten instruction. However, the provisions of this paragraph shall not apply to:
(i) Minors whose parents elect not to enroll their children in school until the following September. (ii) Students enrolled in non-public schools or in home instruction.
