BILL NUMBER:S7553 TITLE OF BILL: An act relating to part-time police officer positions in the villages of Corfu and LeRoy in Genesee county SUMMARY OF PROVISIONS: Section 1 This bill would provide that the position of part-time police officer in the villages of Corfu and LeRoy will be deemed non-competitive positions for purposes of Civil Service. Section 2 provides that this act shall take effect immediately. PURPOSE AND JUSTIFICATION: Many years ago, Genesee County enacted regulations making the position of part-time police officer a competitive position within the county. The regulations in surrounding counties, including Livingston, Orleans and Wyoming Counties, provide that part-time police officer is a non-competitive position. The Village of Corfu and the Village of LeRoy have continuing difficulties finding candidates off the competitive list who are available when needed for a part-time position. These villages have small police departments, but need additional personnel from time to time, such as when an officer is serving in the military reserves or for seasonal demands. The competitive list is for highly trained and specialized candidates who often need over a year of training. Candidates on this list are often not available on a timely basis and may not be interested in a position for what may be only a few hours a week. Also, some of these part time positions are effectively seasonal reflecting increased need during certain times of the year. If the position was non-competitive, these villages would be able to reach out to part-time police officers in the surrounding counties who are in noncompetitive positions, but experienced and well qualified, to fill in needed coverage in LeRoy and Corfu. This bill is supported not only by the Village of Corfu and the Village of LeRoy, but also Genesee County, who recognizes the unique difficulties faced by these two communities within the County. EXISTING LAW: Civil Service Law and Regulations provide that an election to make a position competitive is done on a countywide basis. PRIOR LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT relating to part-time police officer positions in the villages of Corfu and LeRoy in Genesee county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Notwithstanding any law, rule or regulation to the contra ry, part-time police officer positions in the village of Corfu and the village of LeRoy, in the county of Genesee, shall be deemed non-competi tive positions for purposes of civil service.
