TITLE OF BILL: An act to amend the education law, in relation to administering tests to detect or screen for tuberculosis infections

PURPOSE OF THE BILL:

This bill would allow registered nurses to administer purified protein derivative.(PPD) tests or other tests to detect or screen for tuberculosis infections.

SUMMARY OF PROVISIONS:

Section 1 of the bill amends section 6909 of the education law to allow a nurse practitioner to prescribe and order a non-patient specific regiment to a registered professional nurse to administer purified protein derivative (PPD) tests or other tests to detect or screen for tuberculosis infections.

Section 2 of the bill amends section 6527 of the education law to allow a licensed physician to prescribe and order a non-patient specific regiment to a registered professional nurse to administer purified protein derivative (PPD) tests or other tests to detect or screen for tuberculosis infections.

Section 3 of the bill relates to the effective date.

JUSTIFICATION:

Chapter 221 of the Laws of 2002 allowed registered professional nurses to administer purified protein derivative (PPD) tests to detect or screen for tuberculosis. However, there are other tests used to detect or screen for tuberculosis infections that may be more effective. This legislation would allow registered professional nurses to administer those other tests without a patient specific order from a nurse practitioner or licensed physician.

HOYLMAN -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to administering tests to detect or screen for tuberculosis infections THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 4 of section 6909 of the education law, as added by chapter 221 of the laws of 2002, is amended to read as follows: (c) administering purified protein derivative (PPD) tests OR OTHER TESTS TO DETECT OR SCREEN FOR TUBERCULOSIS INFECTIONS. S 2. Paragraph (c) of subdivision 6 of section 6527 of the education law, as added by chapter 221 of the laws of 2002, is amended to read as follows: (c) administering purified protein derivative (PPD) tests OR OTHER TESTS TO DETECT OR SCREEN FOR TUBERCULOSIS INFECTIONS.
