BILL NUMBER:S7757 TITLE OF BILL: An act extending the provision which authorizes Pawling central school district to lease lands not located within such school district PURPOSE: To allow the Pawling Central School District to lease land located outside of the school district. SUMMARY OF PROVISIONS: Section 1 authorizes the Pawling Central School District to enter into a lease agreement for a term of 5 years for a building or facility located outside of the school district, providing the facility is located one-half mile outside of the school district boundary on old Route 55 in the Town of Pawling. JUSTIFICATION: The Pawling Central School District is in need of a new bus maintenance facility as the New York State Department of Transportation has cited their current facility twice for unsafe conditions. The school board has submitted a bond proposal to construct a new facility to district voters three times, and it has been voted down each time. It has been determined that it would not be cost effective to attempt to renovate the current facility. The school district has located property available for lease for a new bus facility; however, it is located outside of the Pawling Central School District. The Board of Education has attempted to work out an arrangement with the neighboring school district to no avail; therefore, the school district is in need of special legislation. LEGISLATIVE HISTORY: This is a new bill. FISCAL IMPLICATIONS: None. EFFECTIVE DATE: This act shall take effect immediately.

AN ACT extending the provision which authorizes Pawling central school district to lease lands not located within such school district
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM BLY, DO ENACT AS FOLLOWS:
Section 1. Notwithstanding any other provision of law to the contrary, or section 403-b of the education law, in so much as it prohibits the leasing of school buildings and facilities outside the school district, the Pawling central school district is authorized to enter into a lease agreement with any person, partnership, or corporation for use and occu pancy of a building, facility or any portion thereof, for use as a school facility, said facility to be located one-half mile outside of the school district boundary on old Route 55 in the town of Pawling, said lease agreement to be for a term of five years, subject to all other terms and conditions of section 403-b of the education law.
