BILL NUMBER:S851 TITLE OF BILL: An act to amend the social services law, in relation to restricting placement of level two or level three sex offenders in any temporary emergency housing or homeless shelters used to house families with children PURPOSE OR GENERAL IDEA OF BILL: Prohibits placing of level 2 and 3 sex offenders in any temporary emergency housing or homeless shelters used to house families with children. SUMMARY OF SPECIFIC PROVISIONS: Adds a new section 131-y to the Social Services Law prohibiting placement of level 2 and level 3 sex offenders in temporary housing or homeless shelters used to house families with children. JUSTIFICATION: This legislation would require municipalities to place homeless level 2 and level 3 sex offenders in adult-only shelters or emergency housing where they will not be in close contact with children. Sex offenders are already barred from living in public housing; this measure extends the same protection to homeless families. This

The social services law is amended by adding a new section 131-y to read as follows: S 131-Y. PLACEMENT OF LEVEL TWO OR LEVEL THREE SEX OFFENDERS. NOTWITHSTANDING ANY INCONSISTENT PROVISION OF LAW, NEITHER THE OFFICE OF TEMPORARY AND DISABILITY ASSISTANCE, NOR A SOCIAL SERVICES OFFICIAL ACTING ON HIS OR HER OWN OR AS AN AGENT PURSUANT TO THIS TITLE, SHALL PERMIT OR CAUSE THE PLACEMENT OF ANY SEX OFFENDER WHO HAS BEEN ASSIGNED A LEVEL TWO OR LEVEL THREE DESIGNATION PURSUANT TO ARTICLE SIX-C OF THE CORRECTION LAW, INTO ANY TEMPORARY EMERGENCY HOUSING OR HOMELESS SHEL- TERS USED TO HOUSE FAMILIES WITH CHILDREN. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law.
