Requires the placement of one recycling receptacle for drink containers for every four waste receptacles on state owned property.
TITLE OF BILL: An act to amend the environmental conservation law and the state finance law, in relation to the collection of drink containers for recycling on state property
PURPOSE: To ensure the full collection of recyclable material on state property.
SUMMARY OF SPECIFIC PROVISIONS: Adds a new paragraph to subdivision 1 of section 27-0717 of the environmental conservation law to require the Department of Environmental Conservation to cooperate and advise other state agencies in implementing this act to ensure compliance and full collection of recyclables on state property.
Adds a new paragraph to subdivision 3 of section 165 of the state finance law to include the provision that for every four waste receptacles, at least one receptacle for drink containers must be made available. Includes the definition of "drink container" as an individual glass, metal, steel or plastic bottle used to contain up to one gallon of a drink.
JUSTIFICATION: Studies have shown that the proximity of recycling containers has greatly increased the rate of recovery of recycled materials when a central location for recycled materials results in a recover rate of only 28%, but the increased availability of recycling containers can increase the recovery rate to 80% or higher. As it is the State's responsibility to encourage responsible waste management, this bill would allow the State to increase the rate of recovery for drink containers that may not otherwise be recycled due to the relative unavailability of receptacles.
PRIOR LEGISLATIVE HISTORY: S.7525 of 2008: Passed Senate S.1108 of 2009-10: Referred to Environmental Conservation S.2643: Voted out of Environmental Conservation and Referenced to Finance
FISCAL IMPLICATIONS: Minimal.
EFFECTIVE DATE: This law shall take effect on the one hundred twentieth day after it is signed into law.
