BILL NUMBER:A10881 TITLE OF BILL: An act to amend the energy law, in relation to appliance and equipment energy efficiency standards for portable light fixtures, bottle-type water dispensers, commercial hot food holding cabinets, portable electric spas and residential pool pumps Purpose: This legislation would authorize the Secretary of State, in-consultation with the President of the New York State Energy Research and Development Authority (NYSERDA), to establish energy efficiency performance standards for portable light fixtures, bottle-type water dispensers, commercial hot food holding cabinets, portable electric spas, and residential pool pumps. Summary of provisions: Section 1 of the bill would amend Energy Law 16-102 by adding seven new. subdivisions, 4-a, 6-a, 21-a, 21-b, 27-a, 27-b and 29-a, to provide definitions for bottle-type water dispenser, commercial hot food holding cabinet, lamp, light fixture, portable elec- tric spa, portable light fixture, and residential pool pump, respective- ly. Section 2 of the bill would amend Energy Law § 16-104(1) by adding port- able light fixtures, bottle-type water dispensers, commercial hot food holding cabinets, portable electric spas, and residential pool pumps, to the list of appliances subject to testing, certification and enforcement of efficiency standards by the Department of State.

ROSENTHAL -- (at request of the Governor) -- read once and referred to the Committee on Energy AN ACT to amend the energy law, in relation to appliance and equipment energy efficiency standards for portable light fixtures, bottle-type water dispensers, commercial hot food holding cabinets, portable elec- tric spas and residential pool pumps THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 16-102 of the energy law is amended by adding seven new subdivisions 4-a, 6-a, 21-a, 21-b, 27-a, 27-b and 29-a to read as follows: 4-A. "BOTTLE-TYPE WATER DISPENSER" MEANS A WATER DISPENSER THAT USES A BOTTLE OR RESERVOIR AS THE SOURCE OF POTABLE WATER. 6-A. "COMMERCIAL HOT FOOD HOLDING CABINET" MEANS A HEATED, FULLY ENCLOSED COMPARTMENT, WITH ONE OR MORE SOLID OR PARTIAL GLASS DOORS, THAT IS DESIGNED TO MAINTAIN THE TEMPERATURE OF HOT FOOD THAT HAS BEEN COOKED IN A SEPARATE APPLIANCE. "COMMERCIAL HOT FOOD HOLDING CABINET" DOES NOT INCLUDE HEATED GLASS MERCHANDISING CABINETS, DRAWER WARMERS OR COOK-AND-HOLD APPLIANCES. 21-A. "LAMP" MEANS AN ELECTRICAL APPLIANCE THAT INCLUDES A GLASS ENVELOPE AND PRODUCES OPTICAL RADIATION FOR THE PURPOSE OF VISUAL ILLU- MINATION, DESIGNED TO BE INSTALLED INTO A LIGHT FIXTURE BY MEANS OF AN INTEGRAL LAMP-HOLDER OR SOCKET. 21-B. "LIGHT FIXTURE" MEANS A PRODUCT DESIGNED TO PROVIDE LIGHT THAT INCLUDES AT LEAST ONE LAMP-HOLDER OR SOCKET AND PARTS TO DISTRIBUTE THE LIGHT, TO POSITION OR PROTECT ONE OR MORE LAMPS AND TO CONNECT ONE OR MORE LAMPS TO A POWER SUPPLY. 27-A. "PORTABLE ELECTRIC SPA" MEANS A FACTORY-BUILT ELECTRIC SPA OR HOT TUB, SUPPLIED WITH EQUIPMENT FOR HEATING AND CIRCULATING WATER. 27-B. "PORTABLE LIGHT FIXTURE" MEANS A LIGHT FIXTURE WHICH HAS A FLEX- IBLE CORD AND AN ATTACHMENT PLUG FOR CONNECTION TO A NOMINAL ONE HUNDRED TWENTY-VOLT, FIFTEEN- OR TWENTY-AMPERE BRANCH CIRCUIT; WHICH CAN BE RELOCATED BY THE USER WITHOUT ANY REWIRING; AND WHICH IS TYPICALLY CONTROLLED WITH A SWITCH LOCATED ON THE LIGHT FIXTURE ITSELF OR ON THE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
