S T A T E O F N E W Y O R K ________________________________________________________________________ 11557 I N A S S E M B L Y June 24, 2010 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. V. Lopez) -- read once and referred to the Committee on Housing AN ACT to amend the public housing law, in relation to tenant represen- tatives on the New York city housing authority THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 3 and 4 of section 402 of the public housing law, as amended by a chapter of the laws of 2010, amending the public housing law relating to modifying the composition of the membership of the New York city housing authority to specifically include tenant representatives, as proposed in legislative bills numbers S.1104 and A.4687, are amended to read as follows: 3. On and after May first, nineteen hundred fifty-eight, the authority shall consist of three members appointed by the mayor, one of whom shall be designated by the mayor as chairman removable at his pleasure. The members other than the chairman first appointed for terms commencing on May first, nineteen hundred fifty-eight, shall be appointed for terms of three and five years, respectively. Thereafter the term of office of each member other than the chairman shall be five years. The mayor shall file with the commissioner of housing a certificate of appointment of the chairman and of each member. Any member other than the chairman may be removed by the mayor for cause after a public hearing. On and after July first in the year next succeeding the year in which this sentence shall take effect, the authority shall consist of [two] ONE additional [members] MEMBER who shall be appointed by the mayor AND SHALL BE REMOVABLE AT HIS OR HER PLEASURE. [Each such additional] SUCH ADDITIONAL member must be eighteen years of age or older and be [a resi- dent of a public housing project of the authority. The initial terms of such additional members shall be as follows: one member shall serve for a term of two years and one member shall serve for a term of three years, thereafter such additional members shall serve for a three year term of office] THE TENANT OF RECORD OR AN AUTHORIZED MEMBER OF THE TENANT HOUSEHOLD, IN GOOD STANDING, RESIDING IN ONE OF THE THREE HUNDRED THIRTY-FIVE FEDERAL PROJECTS OWNED OR OPERATED BY THE AUTHORITY.
