S T A T E O F N E W Y O R K ________________________________________________________________________ 8205 2013-2014 Regular Sessions I N A S S E M B L Y October 24, 2013 ___________ Introduced by M. of A. CORWIN -- read once and referred to the Committee on Local Governments AN ACT authorizing the county of Erie to transfer certain land to the town of Newstead THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding the provisions of any general, special or local law to the contrary, the county of Erie, acting by and through its legislature, is hereby authorized and empowered to transfer, for a sum not to exceed $200,000, the lands described in section two of this act to the town of Newstead, county of Erie. The revenue received by the county of Erie from the transfer of the property described in section two of this act shall be used for capital improvements of existing Coun- ty park land and recreational facilities. The County Executive of Erie county is hereby empowered to execute any such agreements, documents, or papers as may be necessary to implement the intent and purpose of this act. S 2. The lands referred to in section one of this act are more partic- ularly described as follows: Parcel A All that tract or parcel of land situate in the Village of Akron, Town of Newstead, County of Erie and State of New York, being part of Lots Nos. 41 and 42, Township 12, Range 5 of the Tonawanda Reservation, described as follows: Beginning at a point in the south line of Lot No. 42, being also the north line of Lot No. 9, 350.59 feet west of the northeast corner of Lot No. 9: thence west along the common line of Lots Nos. 9, 41 and 42, 280.34 feet to the west line of premises of Leonard Raykowski recorded in Erie County Clerk's Office in liber 5127 of Deeds page 559: thence north along said west line, 944.37 feet to the south line of Skyline Drive: thence easterly along the south line of Skyline Drive, 159.52 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. The county of Erie acting through its legislature is here- by authorized to transfer the park lands described in section two of this act to the town of Newstead, county of Erie for a sum not to exceed $200,000 provided that such town uses such lands for continued park and recreational purposes. The revenue received by the county of Erie from the transfer of the property described in section two of this act shall be used for capital improvements of existing County park land and recre- ational facilities. The town of Newstead shall continue to provide access to the parklands and/or recreational facilities described in section two of this act to all residents of the county of Erie and shall not enact any fees which are higher for the residents of the county who are not residents of the town of Newstead. S 2.
