STEC -- read once and referred to the Committee on Local Governments AN ACT to amend the village law and the public officers law, in relation to the residency of certain officers of the village of Victory, county of Saratoga THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3-300 of the village law is amended by adding two new subdivisions 24 and 25 to read as follows: 24. NOTWITHSTANDING THE PROVISIONS OF THIS CHAPTER OR ANY OTHER GENER- AL LAW, LOCAL LAW, ORDINANCE, OR SPECIAL ACT, THE VILLAGE BOARD OF TRUS- TEES OF THE INCORPORATED VILLAGE OF VICTORY, SARATOGA COUNTY, MAY, BY RESOLUTION, PROVIDE THAT THE VILLAGE CLERK-TREASURER OF THE VILLAGE OF VICTORY, SARATOGA COUNTY, NEED NOT BE A RESIDENT OF SUCH VILLAGE, BUT MUST BE A RESIDENT OF THE COUNTY OF SARATOGA, STATE OF NEW YORK, OR OF A COUNTY WHICH ADJOINS THE COUNTY OF SARATOGA. 25. NOTWITHSTANDING THE PROVISIONS OF THIS CHAPTER OR ANY OTHER GENER- AL LAW, LOCAL LAW, ORDINANCE, OR SPECIAL ACT, THE VILLAGE BOARD OF TRUS- TEES OF THE INCORPORATED VILLAGE OF VICTORY, SARATOGA COUNTY, MAY, BY RESOLUTION, PROVIDE THAT THE DEPUTY CLERK-TREASURER OF THE VILLAGE OF VICTORY, SARATOGA COUNTY, NEED NOT BE A RESIDENT OF SUCH VILLAGE, BUT MUST BE A RESIDENT OF THE COUNTY OF SARATOGA, STATE OF NEW YORK, OR OF A COUNTY WHICH ADJOINS THE COUNTY OF SARATOGA. S 2. Section 3 of the public officers law is amended by adding two new subdivisions 62 and 63 to read as follows: 62. IN THE VILLAGE OF VICTORY, COUNTY OF SARATOGA, THE PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDI- VISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH HE OR SHE SHALL BE CHOSEN OR WITHIN WHICH HIS OR HER OFFICIAL FUNCTIONS ARE REQUIRED TO BE EXERCISED, SHALL NOT PREVENT A PERSON FROM HOLDING THE OFFICE OF VILLAGE CLERK-TREASURER OF THE VILLAGE OF VICTORY, PROVIDED THAT SUCH PERSON RESIDES IN THE COUNTY OF SARATOGA OR AN ADJOINING COUNTY WITHIN THE STATE OF NEW YORK.
