TITLE OF BILL : An act to amend the legislative law, in relation to state spending for fiscal years 2010-2011, 2011-2012 and 2012-2013
SUMMARY OF SPECIFIC PROVISIONS : Section 1 freezes the amount of general fund State spending which can be authorized by the State Legislature for State fiscal years 2010-2011, 2011-2012 and 2012-2013 at 2009-2010 fiscal year amount.
Section 2 establishes the effective date.
JUSTIFICATION : Despite a historic economic recession, the 2009-2010 finalized State Budget contained an unsustainable amount of spending, including new income and numerous other onerous taxes for most New York State taxpayers. In addition, despite a public outcry for Medicaid reform, little was done to address this primary driver of escalating spending. This bill will ensure that spending is contained at current year levels for the 2010-2011, 2011-2012 and 2012-2013 fiscal years. This action will afford New York State taxpayers, who bear the financial burden of these increases, assurance that State government is committed to addressing this runaway spending.

Paragraph (a) of subdivision 2 of section 54 of the legis- lative law, as added by chapter 1 of the laws of 2007, is amended to read as follows: (a) The legislature shall enact a budget for the upcoming fiscal year that it determines is balanced in the general fund. THE TOTAL AMOUNT OF ALL FUNDS SPENDING FOR EACH OF THE STATE FISCAL YEARS TWO THOUSAND TEN- -TWO THOUSAND ELEVEN, TWO THOUSAND ELEVEN--TWO THOUSAND TWELVE AND TWO THOUSAND TWELVE--TWO THOUSAND THIRTEEN INDIVIDUALLY, WHICH SHALL INCLUDE SPENDING FROM ALL STATE REVENUE SOURCES INCLUDING TAXES, FEES, FINES, FEDERAL GRANTS, BOND PROCEEDS, LOTTERY PROCEEDS AND MISCELLANEOUS RECEIPTS, AND WHICH COMPRISES SPENDING FROM THE GENERAL FUND, SPECIAL REVENUE FUNDS, CAPITAL PROJECTS FUND, DEBT SERVICE FUNDS, INTERNAL SERVICE FUNDS, ENTERPRISE FUNDS AND FIDUCIARY FUNDS, SHALL NOT EXCEED TOTAL SPENDING IN THE STATE FISCAL YEAR TWO THOUSAND NINE--TWO THOUSAND TEN; PROVIDED, HOWEVER, THAT SUCH SPENDING MAY EXCEED SUCH AMOUNT BY THE AMOUNT OF ANY UNEXPECTED FEDERAL FUNDS RECEIVED BY THE STATE.
