BILL NUMBER:A10789 TITLE OF BILL: An act to amend the social services law, in relation to requiring a resource test for Medicaid applicants PURPOSE OF THE BILL: This bill requires that all Medicaid applicants are subject to a resource test that will determine eligibility based upon their assets as specified by law. SUMMARY OF PROVISIONS: Section one of the bill amends clause (ii) of sub paragraph (a) of subdivision 1 of section 366 of the social services law to require that all Medicaid applicants must be subject to resource test to determine eligibility. JUSTIFICATION: In 2010, New York State effectively eliminated the resource test for Medicaid applicants in determining eligibility for services:, A resource test is a tool that our local social services departments use in order to verify that a person receiving tax payer funded services actually needs them. The State has limited resources and this asset test will both save money and maximize assistance to those in need. PRIOR LEGISLATIVE HISTORY: New Bill. FISCAL IMPLICATIONS FOR STATE: This bill may have cost savings to Medi- caid due to strict enforce of eligibility requirements.

ZEBROWSKI -- read once and referred to the Committee on Social Services AN ACT to amend the social services law, in relation to requiring a resource test for Medicaid applicants THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Clause (ii) of subparagraph 1 of paragraph (a) of subdivi- sion 1 of section 366 of the social services law, as amended by section 58 of part C of chapter 58 of the laws of 2009, is amended to read as follows: (ii) such person [shall not] MUST be subject to a resource test TO DETERMINE ELIGIBILITY AS SPECIFIED IN SUBPARAGRAPH FOUR OF PARAGRAPH (A) OF SUBDIVISION TWO OF THIS SECTION; S 2.
