BILL NUMBER:A282 TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to authorizing the creation of an alcoholic beverage control board in and by the city of New York PURPOSE OR GENERAL IDEA OF BILL: This bill authorizes the establishment of a New York City Liquor Authority (CLA) in and by the city of New York. Communities in the City of New York have complained that the State Liquor Authority (SLA) which is now empowered to monitor and enforce the rules and regulation of the SLA has too few inspectors to properly provide enforcement. The SLA issues liquor licenses without community input and does not effectively monitor and enforce the alcohol beverage control law. Therefore, quality of life has drastically been impacted. This bill will authorize the creation of the CLA, an agency in the City of New York, which will enable the locality an increased ability to monitor and enforce these laws, which greatly impact on our communities. SUMMARY OF SPECIFIC PROVISIONS: This bill amends the alcohol beverage control law by authorizing the City of New York to create an agency to regulate and enforce the sale of alcoholic beverages within its juris- diction. It provides that a commissioner will be appointed, along with the deputies, officers, employees and hearing officers in order to fulfill the duties of the agency. BRENNAN, CLARK, COLTON, COOK, JACOBS, JOHN, MAYERSOHN, MILLMAN, ROSENTHAL, TOWNS -- read once and referred to the Committee on Economic Development, Job Creation, Commerce and Industry AN ACT to amend the alcoholic beverage control law, in relation to authorizing the creation of an alcoholic beverage control board in and by the city of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Declaration of legislative findings and intent. The legis- lature hereby finds, determines and declares that it is a matter of state concern and in the interest of the people of the state to author- ize the establishment of a city liquor authority in and by the city of New York. The need for self-regulation of the sale of alcoholic beverag- es by the city of New York is well documented. There are too many estab- lishments in close proximity to each other that engage in the sale of alcoholic beverages. This has resulted in an increase in noise, traffic, litter, and criminal activities, especially late at night. Consequent- ly, the quality of life in neighborhoods within the city of New York has deteriorated. Therefore, the legislature finds and declares that the creation of a city liquor authority would enable the city of New York to more effectively and efficiently monitor these establishments and enforce the alcoholic beverage control law. The legislature further finds and declares that the creation of a city liquor authority will help improve the quality of life in the city of New York as well as insure compliance with other applicable laws.
