AN ACT to amend the executive law, in relation to requiring the  instal-
  lation of operable portable fire extinguishers in certain R-3 residen-
  tial occupancies

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 378 of the executive law is amended by adding a new
subdivision 5-d to read as follows:
  5-D. STANDARDS FOR FIRE EXTINGUISHERS REQUIRING THAT EVERY  R-3  RESI-
DENTIAL  OCCUPANCY  IN THIS STATE, CONSTRUCTED OR OFFERED FOR SALE AFTER
THE EFFECTIVE DATE OF THIS SUBDIVISION, SHALL HAVE INSTALLED AN OPERABLE
PORTABLE FIRE EXTINGUISHER OF SUCH MANUFACTURE, DESIGN AND STANDARDS  AS
ARE  ESTABLISHED  BY  THE  COUNCIL. FOR THE PURPOSE OF THIS SUBDIVISION,
"R-3 RESIDENTIAL OCCUPANCY" SHALL HAVE THE SAME MEANING  AS  DEFINED  IN
THE NEW YORK STATE UNIFORM FIRE PREVENTION AND BUILDING CODE.
  S 2. This act shall take effect on the one hundred twentieth day after
it  shall have become a law. Effective immediately, the addition, amend-
ment and/or repeal of any rules or regulations by the secretary of state
necessary for the implementation of section  one  of  this  act  on  its
effective  date  is  authorized  to  be made on or before such effective
date.
